Rocket Mortgage is facing a class action lawsuit claiming that it made repeated, unsolicited, telephone calls to people who asked for the calls to stop.

The Telephone Consumer Protection Act of 1991 (TCPA) requires companies to keep an internal do-not-call list and honor requests to not be called within a reasonable time frame but definitely within 30 days, the Rocket Mortgage calls lawsuit said.

Plaintiff Kellie Deits says that she received a call and requested not to be called back but was then called back at least 27 more times from the same number within 10 days.

“Defendant made numerous such telemarketing calls to plaintiff even after she demanded that she not be contacted again in violation of federal law prohibiting such practice,” the Rocket Mortgage class action says.

The proposed Rocket Mortgage calls class includes “residential telephone subscribers who received more than one telemarketing call within a 12-month period from Rocket Mortgage (or another person or entity calling on its behalf) within five years after requesting Rocket Mortgage not call them,” the lawsuit says.

The plaintiff doesn’t know the exact number of Rocket Mortgage calls potential class members but class counsel believes it is in at least the hundreds based on the complaints the defendant has received.

The plaintiff is asking for an injunction against Rocket Mortgage making future calls violating TCPA as well as statutory damages for each of the calls that violated TCPA.

Rocket Mortgage made its Michigan-based employees attend unpaid “pre-shift” meetings prior to being allowed to clock-in for the day, according to an August class action lawsuit.
