$9.25M Penn Medicine pixel tracking class action settlement

The University of Pennsylvania Health System (UPHS) agreed to a $9.25 million class action settlement to resolve claims it used tracking pixels on its website to share patient information with third parties.

The Penn Medicine settlement benefits individuals who accessed the myPennMedicine patient portal between Jan. 23, 2021, and Jan. 23, 2023, and had a Pennsylvania address on file at the time of access.

According to the class action lawsuit, UPHS violated Pennsylvania privacy laws by using tracking pixels on its website to share patient information with Meta, Google and other third parties. These pixel tracking technologies allegedly shared patient information without consent.

The University of Pennsylvania Health System is a network of hospitals and other medical facilities in Pennsylvania.

UPHS has not admitted any wrongdoing but agreed to a $9.25 million settlement to resolve the pixel tracking class action lawsuit.

Under the terms of the Penn Medicine settlement, class members can receive an equal share of the net settlement fund. Exact payments will vary depending on the number of claims filed with the settlement but are estimated to be around $15 per claimant.

In addition to providing cash benefits, UPHS agreed to make changes to its website governance policies. The health system will not use analytics and advertising technologies on its website for two years unless its Web Governance Committee determines such use is consistent with applicable laws.

The deadline for exclusion and objection is Sept. 1, 2026.

The final approval hearing for the Penn Medicine settlement is scheduled for Nov. 12, 2026.

To receive settlement benefits, class members must submit a valid claim form by Sept. 16, 2026.
