Graco class action lawsuit overview:

A new class action lawsuit alleges Graco’s “Slim Spaces Compact Baby Swing” can accelerate to dangerous speeds due to a defect, posing a serious risk to infants.
Plaintiff Stephanie Haney claims the defect causes the Graco swing to accelerate to high speeds without any user input, even when set on the lowest setting, rendering the speed controls completely inoperative.
Haney argues the alleged defect “poses a direct and serious risk of physical harm or death to infants placed inside the swing.”
“Once this high-speed mode activates, many consumers report that it cannot be lowered or stopped through normal operation, and the problem persists even after battery replacement,” the Graco class action lawsuit says.
Haney wants to represent a nationwide class and California class of consumers who purchased the Graco Slim Spaces Compact Baby Swing.
Graco allegedly knew about the defect ‘for years’ but took no action
Haney claims Graco has been aware of the defect “for years,” based on consumer complaints, filings with the U.S. Consumer Product Safety Commission and media coverage, but has not issued a recall, corrected its product listing or issued a warning to consumers.
Further, Haney argues Graco has instead continued to advertise the swings with the same false and misleading representations.
“Contrary to what Graco promises, Graco does not disclose that the swings contain a serious and pervasive defect that causes them to spontaneously accelerate to high speeds without any user input,” the Graco class action lawsuit says.
Haney claims Graco is guilty of unjust enrichment, breach of contract, breach of express warranty and implied warranties, negligent misrepresentation and fraudulent misrepresentation and omission under the California’s False Advertising Law, Unfair Competition Law and Consumers Legal Remedies Act.
The plaintiff demands a jury trial and requests injunctive relief and an award of compensatory and punitive damages for herself and all class members.
In March 2013, a consumer filed a separate complaint against Graco claiming it sold defective car seat harness buckles and that the recall was inadequate and did not offer a full refund.
