Bissell customer service calls class action lawsuit overview:

Vacuum cleaner and floor care products manufacturer Bissell Inc. secretly monitors and records calls between its customer service representatives and consumers without first providing notice or receiving consent to do so, a new class action lawsuit alleges.
Plaintiffs Brie Baldwin, Rolanda Fields, Samuel Gemette, Tyasia Reddic, Terrence Wilson and Erma Tucker claim Bissell is in violation of the California Invasion of Privacy Act (CIPA) by allegedly not disclosing it is recording the interactions.
“Secret monitoring and recording denies customers an important aspect of their privacy: the right to control the nature and extent of the information they disclose,” the Bissell class action states.
The plaintiffs want to represent California classes of consumers who participated in an inbound or outbound call with Bissell or one of its agents, with a separate class for individuals who did so while using a cellular telephone.
Bissell should disclose it is allegedly records customer service calls, class action says
The company, in order to stay within the law, would need to disclose at the start of a call that it would be recording communications between its customer service representatives and consumers, the class action alleges.
“Because Defendant fails to disclose to consumers that it is recording telephonic communications at the outset of the call, Defendant violated and continues to violate the (CIPA),” the Bissell class action states.
The plaintiffs are demanding a jury trial and requesting declaratory and injunctive relief, along with an award of statutory damages for themselves and all class members.
A separate class action lawsuit was filed against Bissell in January by a consumer arguing the company sold certain vacuums that allegedly contained a defect that caused them to overheat and potentially catch fire.
