Dark Horse Comics failed to design, construct, and maintain its website in a way that would make it fully accessible to blind and visually impaired individuals, a new class action lawsuit alleges.
Plaintiff Rafael Cordero, a blind man, claims that the Dark Horse Comics website is not compatible with the blind and visually impaired screen-reading software to browse the internet.
Cordero wants to represent a nationwide Class and New York subclass of blind and visually impaired individuals who have been denied access to the “equal enjoyment of goods and/or services on Dark Horse Comics’ website.
Dark Horse Comics’ has multiple access barriers for individuals using screen-reading software, the Dark Horse Comics class action alleges.
Dark Horse Comics’ Website Not Compatible With Screen Reader
Cordero claims screen-reading software is unable to add a shoppers email to the website and will continuously read “endless links” rather than opening a selected item.
The access barriers remain on Dark Horse Comics’ website to this day, according to the Dark Horse Comics class action.
“The access barriers that Plaintiff encountered have caused a denial of Plaintiff’s full and equal access multiple times in the past, and now deter Plaintiff on a regular basis from accessing the Defendant’s website in the future,” states the Dark Horse Comics class action.
Cordero claims Dark Horse Comics is in violation of the Americans with Disabilities Act and New York City Human Rights Law.
Plaintiff is demanding a jury trial and requesting injunctive and declaratory relief along with statutory, actual, and punitive damages for himself and all Class Members.
A similar class action lawsuit was filed earlier this month against Uncommon Goods over claims the company failed to make its website equally accessible to blind and visually impaired individuals.
