Uncommon Goods Website ADA Class Action Lawsuit Overview: 

  • Who: Jose Mejia filed a class action lawsuit against Uncommongoods, L.L.C.
  • Why: Mejia claims Uncommon Goods’ website is not equally accessible to blind or visually impaired individuals. 
  • Where: The class action lawsuit was filed in New York federal court. 

Uncommon Goods failed to design its website to be entirely accessible for visually impaired individuals, a new class action lawsuit alleges.

Plaintiff Jose Mejia, a blind man, claims he has been denied access to the “equal enjoyment of goods and/or services offered” on Uncommon Goods’ website. 

Mejia claims Uncommon Goods’’ website is not entirely compatible with screen-reading software used by blind and/or visually impaired individuals to browse the internet. 

Among other things, Mejia argues that, when on Uncommon Goods’ website, his screen reader is unable to read all of the text, properly describe images and announce when an item is added to the cart. 

Uncommon Goods Class Action Alleges ‘Issues’ Still Present On  Website

“The accessibility issues Plaintiff experienced are still found on Defendant’s website as of the date of the filing of this complaint,” the Uncommon Goods class action states. 

Mejia claims Uncommon Goods and its website are in violation of the Americans with Disabilities Act of 1990 (ADA).

Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with compensatory, statutory and punitive damages for himself and all class members. 

Mejia wants to represent a nationwide class of blind and/or visually impaired individuals who have been denied equal access to Uncommon Goods’ website. 

A similar class action lawsuit was filed last month against Choice Hotels by a legally blind man claiming the company violates the ADA by not making its website accessible to blind individuals.
