HSN ADA Website Accessibility Class Action Lawsuit Overview: 

  • Who: Christopher Loadholt filed a class action lawsuit against HSN, Inc. 
  • Why: Loadholt claims HSN is violating the Americans with Disabilities Act by not making its website fully accessible to blind and visually impaired individuals.
  • Where: The class action lawsuit was filed in New York federal court.

HSN failed to design and maintain its website in a way that would make it fully accessible for blind and visually impaired individuals. 

Plaintiff Christopher Loadholt, a legally blind man, claims HSN is in violation of the Americans with Disabilities Act by denying blind and visually impaired consumers “full and equal access” to its website.

Loadholt wants to represent a nationwide Class and New York subclass of legally blind individuals who have attempted to browse HSN’s website and been denied access to the “equal enjoyment of goods and services.” 

Loadholt argues HSN’s website has multiple access barriers which make it not fully compatible with screen-reading software used by himself and other legally blind individuals to browse the internet. 

HSN Accused of Having Multiple Access Barriers on Website

Access barriers on HSN’s website include a failure to properly label titles, multiple broken links, and vague headings, among other things, according to the HSN class action. 

“These access barriers effectively denied Plaintiff the ability to use and enjoy Defendant’s website the same way sighted individuals do,” states the HSN class action. 

Loadholt claims that, in addition to violating the ADA, HSN is in violation of New York City Human Rights Law. He is seeking declaratory and injunctive relief along with compensatory, statutory, and punitive damages for himself and all Class Members. 

A similar class action lawsuit was filed earlier this month against Dell over claims the company violated the ADA by failing to make its website accessible to individuals who use a screen reader

    I’m legally blind and it’s not just HSN. I was doing classes online and the schools didn’t do anything to assist me with my visual impairment and I asked for assistance and the school never help me at all.

    I am visually impaired and my mother is too. She could not maneuver their web site but she had to call directly to order from the tv channel all the time.
