Mrs. Fields Website ADA Class Action Lawsuit Overview:

Mrs. Fields Famous Brands failed to design its website in a way that would make it fully accessible for blind and visually impaired individuals, a new class action lawsuit alleges.
Plaintiff Elbert Dawkins, a blind man, claims Mrs. Fields’ failure to make its website equally accessible to blind and visually impaired individuals is a violation of the Americans with Disabilities Act (ADA).
Dawkins argues he was “effectively barred” from being able to see the products for sale on Mrs. Fields’ website due to its “lack of a variety of features and accommodations.”
Mrs. Fields Website Not Fully Compatible With Screen Readers
Dawkins claims Mrs. Fields’ website is not designed to be fully compatible with the screen-reading software he and other blind and visually impaired individuals use to browse the internet.
“Many features on the Website also fail to Add a label element or title attribute for each field. This is a problem for the visually impaired because the screen reader fails to communicate the purpose of the page element,” the Mrs. Fields class action states.
Dawkins demands a jury trial and requests declaratory and injunctive relief along with compensatory, statutory and punitive damages for himself and all class members. He wants to represent a nationwide class and New York City subclass of legally blind individuals who have been denied the equal enjoyment of goods and services on Mrs. Fields’ website.
A similar class action lawsuit was filed against HelloFresh earlier this month by a consumer arguing the company failed to design its website to be fully accessible for individuals who are blind or visually impaired.
