Update:

  • A class action lawsuit accusing Ashley Furniture of running a deceptive pricing scheme was voluntarily dismissed without prejudice in a California federal court. 
  • Stephanie Aberl, the consumer behind the complaint, chose to drop her claims against the furniture company.
  • No reason was given for the voluntary dismissal. 
  • Ashley Furniture had been accused of using fake original sale prices to make consumers believe they were getting items at a discounted price. 
  • Aberl claimed Ashley Furniture violated a trio of California consumer protection laws, as well as allegedly being guilty of fraud.  
  • The complaint was originally filed in April 2022, with Aberl demanding a jury trial at that time.

Ashley Furniture Industries LLC faces a false advertising class action lawsuit alleging the furniture chain dupes customers with fictitious “original” prices, leading them to falsely believe they are purchasing furniture at bargain prices.

Plaintiff Stephanie Alberl of California says she relied on Ashley’s deceptive pricing scheme when she purchased a metal twin bed and mattress from the company’s website. The twin bed allegedly was listed at a sale price of $96.99 with a reference price listed at $159.99.

Aberl alleges she decided to purchase the metal twin bed because she believed the discounted price would not last long, and she believed she received a significant bargain of nearly 40% off the regular price of the bed.

“However, this product was never offered for sale at the original price listed on Ashley Furniture’s e-commerce website and certainly not within the 90 days preceding [Aberl’s] purchase,” the deceptive pricing class action lawsuit alleges. “Nor was it listed for sale at the full price in an Ashley Furniture brick and mortar store.”

Ashley Furniture false reference pricing artificially inflates true market price, plaintiff claims

The class action lawsuit explains that false reference pricing occurs when a seller lists a fake “original” price for a product and offers the product at a significantly lower “sale” price to entice bargain hunters to purchase the product.

This type of deceptive pricing allegedly “artificially inflates the true market price for these products by raising consumers’ internal reference price and in turn the value consumers ascribe to these products.”

Retailers are thus able to sell products at prices above their true market price and value, leaving customers to pay inflated prices, according to the deceptive pricing class action lawsuit.

The class action lawsuit asserts claims for violations of California’s unfair competition laws, false advertising laws and the California Consumer Legal Remedies Act.

Aberl filed the deceptive pricing class action lawsuit on behalf of herself and a proposed class of people in California who purchased one or more products from the Ashley website that were advertised at a discount from an advertised reference price who have not received a refund or credit for their purchase.

Ashley has also faced allegations that it failed to list promised delivery dates on sales documents in violation of New Jersey state laws.

    Let’s also talk about their “bait and switch” tactics. I ordered a couch based on the showroom model and received a lesser quality construction of the same couch. The interior base construction and the pillow stuffings were completely different, cheaper, and terrible. I would never have purchased that couch if I knew how uncomfortable and hard it would be. Had the couch two days and am now in a dispute for them to send me the correctly constructed couch. Will never shop with them again.

    I have multiple sclerosis and congested heart failure along with sleep apnea. I Went to Ashley’s furniture to buy a bed , I only wanted to spend $4000 but somehow I was talked into buying a split adjustable bed that cost me nearly $10,000 .
    They led me to believe I was getting a good deal when they threw in a cheap recliner for free. They then talked me out of getting the
    mattress I wanted, which were Fosters and told me if I was not satisfied after 30 days I could return them for the original ones. When the base was delivered one didn’t work and there was a missing sync cord so we can’t sync the beds together!
    My husband got the base to work, but the protective mattress cover they sent was for a king bed and not for a split adjustable which requires 2. XL twins! For the next 30 days I slept on a mattress I absolutely hate! I couldn’t wait for those 30 days to end so I could get the mattress I originally wanted. When I finally was able to speak with the store manager I was informed that i would have to trade for another tempur pedic! That’s not what I was told when I was purchasing them . The original beds I wanted are Fosters! After many long arguments with David the manager at the Victorville California store I was told that he would speak with his advisors and let them know the situation and see if they will honor my request for the Fosters since they didn’t provide me with the correct information from the very beginning concerning what I could trade the mattress for upon my dissatisfaction . I was also promised a free headboard worth $200 and the
    delivery of the correct mattress protectors. It’s now been over two months and I finally received the protectors but still no mattress and no headboards! I’ve tried to call the manager David but when they tell him who’s calling he informs them to take a message and does not take my calls! I’ve made many complaints to Ashley’s furniture,and tried to contact Todd Waneck the CEO of Ashley’s but never once has he returned my emails. It makes me wonder if he actually condones this type of unprofessionalism from his employees! I’m very sick and on hospice, I spend most of my days in a bed that is so very uncomfortable and does nothing to relieve the pain they claimed it would . My husband spent nearly $10,000 for this bed and still to this very day Ashley’s furniture has not fulfilled any of their promises, they have no integrity! They are con artists dressed is suits who rob from the old and dying . I’m disgusted with the store they have no ethics And absolutely zero integrity!

    They delivered the my bed mattress and base unit but the base unit is broken they told me they cannot leave the base unit i need to wait for new one. I am sleeping with my mattress on the floor waiting for my base unit for my bed. I have a back problem

    I have been through Hell dealing with Ashley. After 3 months of delays and hassling, Instead of sending me back my full refund, they finally sent me a chair and 2 lamps. I went to another store and ordered a sofa (manufactured by Ashley, can’t get away from those people). But they still owe me a refund on my first order and they switched the new sofa. I want to call them out for bad treatment and just taking my money. Help!

    I regret I purchased my recliners from Ashley and had all experience which other buyers experienced. Price manipulation , false advertising , protection plan scam. please add me and ill provide evidence against Ashley Furniture aka Sicilian Mafia!

    I purchased a mattress from Ashley furnature and checked the box for them to remove my old mattress. Was even charged a recycle fee. Says on receipt and even their page says removal is free when you purchase a new mattress. I called the number confirming deliver and they said they do not remove the old mattress and i told her my receipt and the internet say you do. The person i spoke to to confirm delivery also said you do when i asked her. Today deliver was supposed to be between 8am and noon. I get a phone call at 7:11 am saying deliver will take place in 4 minutes. I jump out of bed and go to door to meet them and mattress is already leaning against the wall. It was delivered earlier then 7 am and I was never notified, didn’t ring bell and I never signed for it but it required a signature. Even more annoying is they did not remove my old mattress as promised so I called and filed a complaint. This goes against California’s recycling program and also charging a recycle fee and not taking the old mattress.

    This company is robbery. We purchased a sectional that cost over 3,000. I told the salesman I don’t know if this will fit, I can order it later once I check. He said dont worry about that, lets measure it here and you can go check at home. If it doesnt fit just call and we can cancel as long as it hasn’t left the warehouse. It didn’t fit, so I called back and asked if I could switch to a different sectional and they told me it would cost me 15% of the previous price. And 30% to cancel. I asked my credit card company to stop the sale and they did. So now I’m waiting to see what happens.

    Thousands of dollars later and no furniture i am going through hell dealing with Ashley furniture and 5starservice warranty company. I have purchase agreements and all of the emails and text messages. Crooks!

    I purchased a couch and table on a lease to own from them two years ago. They had a sale going on. I was told one payment price, but ended up being sent a different payment price (it was less). I paid the lesser amount, unknowing that the sale price I got the furniture at was a promotional deal that would end after 2 years. When the promotion ended, I still have a little over 1100 (1400 without promotion) left to pay and they suddenly added 1700 in “interest” saying it was because my promotion had ended. They refuse to take off the interest. Said they can’t. Told them if they take it off I will have it paid at tax returns (which was my original intention). They said they couldn’t, but said if I could come up with the promotional amount in the next two weeks there was a “leeway” and it would count as paying off on time….. How can they charge an insane amount of interest (on top of charging me monthly interest)? I have a feeling had I been making the payments they originally quoted and not the ones they sent me later that it would have been paid off during their “promotional” time…. I feel that Ashleys is just run by a bunch of crooks looking for loopholes to take more money from their customers.
