Update:

  • A class action lawsuit accusing Ashley Furniture of running a deceptive pricing scheme was voluntarily dismissed without prejudice in a California federal court. 
  • Stephanie Aberl, the consumer behind the complaint, chose to drop her claims against the furniture company.
  • No reason was given for the voluntary dismissal. 
  • Ashley Furniture had been accused of using fake original sale prices to make consumers believe they were getting items at a discounted price. 
  • Aberl claimed Ashley Furniture violated a trio of California consumer protection laws, as well as allegedly being guilty of fraud.  
  • The complaint was originally filed in April 2022, with Aberl demanding a jury trial at that time.

Ashley Furniture Industries LLC faces a false advertising class action lawsuit alleging the furniture chain dupes customers with fictitious “original” prices, leading them to falsely believe they are purchasing furniture at bargain prices.

Plaintiff Stephanie Alberl of California says she relied on Ashley’s deceptive pricing scheme when she purchased a metal twin bed and mattress from the company’s website. The twin bed allegedly was listed at a sale price of $96.99 with a reference price listed at $159.99.

Aberl alleges she decided to purchase the metal twin bed because she believed the discounted price would not last long, and she believed she received a significant bargain of nearly 40% off the regular price of the bed.

“However, this product was never offered for sale at the original price listed on Ashley Furniture’s e-commerce website and certainly not within the 90 days preceding [Aberl’s] purchase,” the deceptive pricing class action lawsuit alleges. “Nor was it listed for sale at the full price in an Ashley Furniture brick and mortar store.”

Ashley Furniture false reference pricing artificially inflates true market price, plaintiff claims

The class action lawsuit explains that false reference pricing occurs when a seller lists a fake “original” price for a product and offers the product at a significantly lower “sale” price to entice bargain hunters to purchase the product.

This type of deceptive pricing allegedly “artificially inflates the true market price for these products by raising consumers’ internal reference price and in turn the value consumers ascribe to these products.”

Retailers are thus able to sell products at prices above their true market price and value, leaving customers to pay inflated prices, according to the deceptive pricing class action lawsuit.

The class action lawsuit asserts claims for violations of California’s unfair competition laws, false advertising laws and the California Consumer Legal Remedies Act.

Aberl filed the deceptive pricing class action lawsuit on behalf of herself and a proposed class of people in California who purchased one or more products from the Ashley website that were advertised at a discount from an advertised reference price who have not received a refund or credit for their purchase.

Ashley has also faced allegations that it failed to list promised delivery dates on sales documents in violation of New Jersey state laws.

    I purchased an extended protection plan with Ashley furniture and was denied a recent claim on my sofa. The protection plan was for 5 years and I was told due to misuse and abuse I would not be allowed to receive repairs to my sofa. My sofa is falling apart at the seams. I work long hours and my sofa is barely used. It is falling apart due to poor craftsmanship.

    Me too… purchased bedroom set and they are “if you find lower price we will match it” come to find out they don’t and they put loopholes in it so they don’t have to price match. They don’t discount if the reduced price is given as $$$ or % off. And they limit who prices they will match to places that don’t sell same merchandise like Walmart.com or target.com.

    Please add me. They refuse to send someone to look at my couch that broke twice and has been fixed by them once. They stopped responding to me and denied my claim without coming to inspect

    pls add me to your class action too. I bought furniture from them and returned part of the items and it has been 9 months already and they have not credited my the $500.00 they owe me. They keep giving me the run around that I have to wait 2 billing cycles and I have already waiting 4 billing cycles and no credit has been rendered. The Cust. Service is very short and rude; they keep you on hold and sometimes even hang up on you because they know when the consumers call back they have to wait for at least 1 hour to speak with anyone….

    My 79yr old mother purchased furniture and the sofa frame was broke. The delivery person set the the pillow up so she could not see the damage but when she asked me to center the sofa I noticed the frame was broke. I went to the store the next day and they asked me to send pictures to customer care dept and I sent 2 pictures of the damaged item and now they are telling me I needed to send 3 pictures in two business days of delivery (furniture was delivered on Veterans day). I requested to speak w a manager and was denied a member of management Frajz told me she could not provide her manager name but a manager will be calling me ( still have not heard from management). I sent 3 pictures tdy and still have not received a call yet. I was on the phone w a rep for at least 45 min and they not saying if they received pictures or that the furniture was damaged. This is worse EXPERIENCE stay away from Ashley furniture.

      I have experienced the same issues with Ashley failing to deliver items ordered almost 90 days before everything arrived during the delivery door frame was damaged inside the home I was asked to send over pictures and I continued to call and keep in contact with Ashley management but there was never nothing done they even sent out someone to take their own pictures and I still never heard back from them also I purchased a 17-in mattress and received a 14-in mattress by delivery which was defected and one year later I still have not heard anything from them

        Also the material of the bedroom set that I purchased is not 100% wood so please inspect your furniture before leaving the store because it is false advertisement and so is the sales offers if they think they can pull one over on you they would most definitely will try I paid for delivery and set up which they never did set up anything they deliver Mitch Mac pieces to my bedroom set they continue to give me false delivery dates and I pay cash up front I thought it would make the situation go a little smooth because a friend of mine had a lot of issues going on with her delivery as well 6 months later and she still have not received all the pieces to one bedroom set she purchased

          I still have not received all my pieces in Texas and it’s now 6 months later. Also, they promised no credit card payments with TD Bank & Synchrony bank until 45 days after all furniture is delivered. They have been billing me late fees because I haven’t paid since I haven’t received all my furniture yet!

    I brough a Dresser from Ashley furniture store in the state on New Jeresy it came inbroken parts I request my money back they return
    The $63,00 one time $184.45 They taken from my card $474.54 they refure to give me the remain of my money.

    I told them I’m recovering from brain surgery I needed the bed to transition from the recliner. They took advantage of my condition told me what I wanted to hear and failed to deliver.

    PLEASE add me! I made an instore purchase yesterday. I was rushed through the process and was told by the salesperson that everything would be sent to my email. Once I received the email I discovered that I was charged double of what I thought I was paying. I called the store over and over before someone finally answered. I was told that the store manager was busy and wasn’t allowed to speak to them. I requested that the order be canceled and my deposit put back on my card. I was told that all sales are final. I demanded that the order be canceled and my deposit refunded. He said that it had to be investigated. I am waiting to hear back. STAY AWAY FROM THESE UNDERHANDED PEOPLE. THEY ARE VULTURES.

      You can add Ashley Furniture of Batesville, AR to this list. Rush, rush, then when I tried to pull of the bed base they sold me it is not even online where I could look at it. I called and asked if this was the base they had the mattress on I tried out and of course it is not. NOT sure what I’m getting, but I’m sure I was Got….

    Adde me. Ashley sold me a set more than the sale price and the chicken s are breaking can you repair once but that didn’t do it. I purchased in July 2022.
