  • A class action lawsuit accusing Ashley Furniture of running a deceptive pricing scheme was voluntarily dismissed without prejudice in a California federal court. 
  • Stephanie Aberl, the consumer behind the complaint, chose to drop her claims against the furniture company.
  • No reason was given for the voluntary dismissal. 
  • Ashley Furniture had been accused of using fake original sale prices to make consumers believe they were getting items at a discounted price. 
  • Aberl claimed Ashley Furniture violated a trio of California consumer protection laws, as well as allegedly being guilty of fraud.  
  • The complaint was originally filed in April 2022, with Aberl demanding a jury trial at that time.

Ashley Furniture Industries LLC faces a false advertising class action lawsuit alleging the furniture chain dupes customers with fictitious “original” prices, leading them to falsely believe they are purchasing furniture at bargain prices.

Plaintiff Stephanie Alberl of California says she relied on Ashley’s deceptive pricing scheme when she purchased a metal twin bed and mattress from the company’s website. The twin bed allegedly was listed at a sale price of $96.99 with a reference price listed at $159.99.

Aberl alleges she decided to purchase the metal twin bed because she believed the discounted price would not last long, and she believed she received a significant bargain of nearly 40% off the regular price of the bed.

“However, this product was never offered for sale at the original price listed on Ashley Furniture’s e-commerce website and certainly not within the 90 days preceding [Aberl’s] purchase,” the deceptive pricing class action lawsuit alleges. “Nor was it listed for sale at the full price in an Ashley Furniture brick and mortar store.”

Ashley Furniture false reference pricing artificially inflates true market price, plaintiff claims

The class action lawsuit explains that false reference pricing occurs when a seller lists a fake “original” price for a product and offers the product at a significantly lower “sale” price to entice bargain hunters to purchase the product.

This type of deceptive pricing allegedly “artificially inflates the true market price for these products by raising consumers’ internal reference price and in turn the value consumers ascribe to these products.”

Retailers are thus able to sell products at prices above their true market price and value, leaving customers to pay inflated prices, according to the deceptive pricing class action lawsuit.

The class action lawsuit asserts claims for violations of California’s unfair competition laws, false advertising laws and the California Consumer Legal Remedies Act.

Aberl filed the deceptive pricing class action lawsuit on behalf of herself and a proposed class of people in California who purchased one or more products from the Ashley website that were advertised at a discount from an advertised reference price who have not received a refund or credit for their purchase.

Ashley has also faced allegations that it failed to list promised delivery dates on sales documents in violation of New Jersey state laws.

    I bought a 2,000.00 couch sectional in California “in-store” and the price was inflated and the salesman pushed the sale, today only. I was super excited to get a couch for my new house and I let him know that and he did what they do in sales, he got me., Once the couch was delivered in boxes it was dirty and they said it was the last one but it wasn’t unless they took the one apart on the show room floor. Either way, they were deceptive and they lied.

    I bought love seat & sofa was told we were looking at a quality leather set, mind you im 62 yrs old i live alone and im a business owner the reason thats important is my time at home is few its not like I have alot of company or spend all my time at home. And when i am my recliner is where I spend my time, not the sofa or love seat. One day i notice a spot forming and ten like stress cracks it should be doing that because I bought the leather treatment, so i pay no attention for a while busy with my business and traveling I look at it big spot of leather was missing in places I don’t sit and started getting bigger and more wide spread now both sofa and love seat has become very noticeable,This so call great leather set is acting more like fake leather I had never seen leather that starts to disappear. I contact them and mthey started playing the time game with me not even willing to talk about it or come and take a look. Also I must be totally transparent I bought my furniture from Mathis brother which is an affiliate / owner of Ashley’s furniture any way furniture manufacture by ashleys furniture. Im tired of being treated like I dont matter paying more receiving less no one takes responsibility or held accountable any more theres no longer consumer law support with out being felt like you are in the wrong and manufacture does have to provide any proof to claim what they call leather has proof . I just want my furniture replaced because they knew there quality isnt there

    Purchase recliner told by the salesperson that it would support 450 lbs person they delivered it try it out and didn’t support 450lb person it flop over. So in Oregon you have 3 business days to return it they refused to except it back. They broke the law they are dishonest and thieves. Also they said my recliner was on sale when it was full price. There are other furniture stores to buy from and online. Don’t shop at Ashley’s their crooks

    I ordered stools from online and they were all damaged and they keep giving me the runaround about retiring the items. No one will speak with max I keep getting the system. Which says my return has been initiated and I will hear something in a few days but it has been 1 month.

    I bought a living room set from Ashley in Arkansas and it took them over a year to received my other sofa. They charge you 200.00 for a third party delivery. I notice that the sales they give you will be double the price. This is ridiculous. I just got mu bed and drawer delivered and that was over what I thought it would be plus another 200.00 added for a 3rd party delivery. With all this money they are making why they doesn’t have their own delivery guys instead of getting someone off the street. It makes the company look bad and make you paranoid because they are not with the company.

    I bought a sectional sofa from Ashley furniture store in San Antonio. I was waiting for it and a bit excited but the delivery guy only had his phone and when he put it together it didn’t fit my living room. I made the mistake of signing for it. After he left I took a closer look and found out that it was not the one I ordered. It was the opposite one. My paperwork and the driver paperwork were the same but the sofa was the opposite of the paperwork. The immediately called the store and notified them about the sofa. I was told that it was the wrong one at the time and apologized and said that the manager would call me back either that evening or tomorrow morning well, it came and went and nothing so I started calling the store. I started calling the sales clerk that helped us and nobody would answer my calls and finally we started messaging back-and-forth and they told me too bad so sad that I was to keep it because I signed for it .
    I kept telling them that it wasn’t what I had ordered. I don’t understand why I have to keep something I didn’t order and have to pay for it also? Someone out there has to help?

    I bought a sectional that was suppose to be brown because they had a gray one on display, so when it was delivered it was sand which is really light colored. I wasn’t at home for the delivery but my daughter was. The thing don’t fit together and it’s light colored trying to get them to fix their mistake but they keep saying it’s what we picked out. No it’s not he said brown and we got sand…
