Update:

  • A class action lawsuit accusing Ashley Furniture of running a deceptive pricing scheme was voluntarily dismissed without prejudice in a California federal court. 
  • Stephanie Aberl, the consumer behind the complaint, chose to drop her claims against the furniture company.
  • No reason was given for the voluntary dismissal. 
  • Ashley Furniture had been accused of using fake original sale prices to make consumers believe they were getting items at a discounted price. 
  • Aberl claimed Ashley Furniture violated a trio of California consumer protection laws, as well as allegedly being guilty of fraud.  
  • The complaint was originally filed in April 2022, with Aberl demanding a jury trial at that time.

Ashley Furniture Industries LLC faces a false advertising class action lawsuit alleging the furniture chain dupes customers with fictitious “original” prices, leading them to falsely believe they are purchasing furniture at bargain prices.

Plaintiff Stephanie Alberl of California says she relied on Ashley’s deceptive pricing scheme when she purchased a metal twin bed and mattress from the company’s website. The twin bed allegedly was listed at a sale price of $96.99 with a reference price listed at $159.99.

Aberl alleges she decided to purchase the metal twin bed because she believed the discounted price would not last long, and she believed she received a significant bargain of nearly 40% off the regular price of the bed.

“However, this product was never offered for sale at the original price listed on Ashley Furniture’s e-commerce website and certainly not within the 90 days preceding [Aberl’s] purchase,” the deceptive pricing class action lawsuit alleges. “Nor was it listed for sale at the full price in an Ashley Furniture brick and mortar store.”

Ashley Furniture false reference pricing artificially inflates true market price, plaintiff claims

The class action lawsuit explains that false reference pricing occurs when a seller lists a fake “original” price for a product and offers the product at a significantly lower “sale” price to entice bargain hunters to purchase the product.

This type of deceptive pricing allegedly “artificially inflates the true market price for these products by raising consumers’ internal reference price and in turn the value consumers ascribe to these products.”

Retailers are thus able to sell products at prices above their true market price and value, leaving customers to pay inflated prices, according to the deceptive pricing class action lawsuit.

The class action lawsuit asserts claims for violations of California’s unfair competition laws, false advertising laws and the California Consumer Legal Remedies Act.

Aberl filed the deceptive pricing class action lawsuit on behalf of herself and a proposed class of people in California who purchased one or more products from the Ashley website that were advertised at a discount from an advertised reference price who have not received a refund or credit for their purchase.

Ashley has also faced allegations that it failed to list promised delivery dates on sales documents in violation of New Jersey state laws.

    I asked do they sell the brackets for headboard they said yes, and I ordered items they said would take 7 to 10 days. I paid for everything then the receipt said 6,8, up to 12 weeks for delivery. Then 1 month later they told me they don’t have/carry the brackets for the headboard, we will give you a refund but 60 dollars of the 85 dollars will go to delivery charges unless you buy something in the bedding dept. When the delivery came they delivered a dresser not a chest. Then they told me that you have to pick up the rug yourself after they told me it would me delivered. They told me that they can order the chest dresser for me, it is out of stock, but it should be in stock Monday. Now Monday it is still out of stock do not know when it will be coming. I had them cancel the order and they charged me a restock fee, then they said it is not a restock fee it is a cancelation fee. They charged me a fee for canceling an order because they do not have the item, can not show me a picture of the item so they won’t make the same mistake again. So I have been calling and asking for a supervisor and the people said this might be corporate phone number but there is no supervisor of such here at the Brandywine, MD location. So now I am out of 100 dollars with an incomplete bedroom set. They took my money and then lie to me in my face. Yes, count me in in the class action lawsuit My items were brought during the Memorial Day 2023 at the Pasadena, MD location.

    I am currently on the phone fighting to have my furniture that is less that 7 months old covered. They sent me an email stating: “This is Ashley Furniture reaching out regarding your last technician visit. “Unfortunately, we do not cover damage or stain claims caused by use of the product. The Ashley warranty would only cover manufacture defect claims.”
    What technician visit??? I just filed the claim today. A tech has not seem the furniture! I am trying to get Ashley’s corporate phone number and they will not give it to me.

    We went into the Ashley furniture store because of sale ads. When we called about a certain piece of furniture, the sales person told us to come on in – well give you a better Prince than advertise. Neither price was given once we enter the store. Plus their furniture is junk. Breaks within 6 months.

    Hi, I am also an Ashley Furniture buyer, soo, I purchased this beautiful bed that suppose to be real wood, when they delivered it, it had bump marks in different little places, if you just bump the wood it will leave a mark, I thought they had some kind of sealant to cover the wood to keep it secured, from a lot of scratches, but that’s not the case, I’m paying almost $2000 for just a bed and the wood or the money is not worth it. I have an $1300 bedroom suit that I’ve had for about 15yrs or more, yes it has scratches, I’ve moved 3 times with this same set and it’s still in great shape, I haven’t moved anymore since I’ve purchased this bed and do not plan to, I’m just simply saying, I don’t think this is real high quality wood, I love this bed, but with the price of it, it could be better. The color seal that you guys have on this bed, is not sealed, this is a dark chocolate cover, but if you bump it, you will see the light part, actually, it’s like a dark spray and if so, it needs to be more secure

      Hi, I have the same issue with the King size bedroom set I bought. They told that the design has a unique markings. They broke the 2nd drawer of my Chest during assembly and they said they will replace it. But every time they send a replacement it’s either broken or wrong drawer and it always have scratches.

    I just recently purchased a table and bed from Ashley furniture and was told by the sales rep who sold me the products that my items would be delivered and assembled which was not the case because they said the delivery for my bed was considered a threshold delivery so they would only put the table together. On May 30, 2023 I tried putting the bed together and it was missing screws, I called Ashley furniture and they told me they can have screws delivered to me in 7-10 business days. At that point I am so dissatisfied I request a return of all items and they are saying that I cannot return the table because it is outside of their refund date which is 72 hours after the purchase date of the item. Now I purchased these items on May 21, 2023 and they were not delivered until May 26, 2023. Ashley is definitely running a deceptive practice because how can you tell someone they have 72 hours from the date of purchase when the date of delivery was 5 days after the purchase date.

      I also wanted to return my purchase but Ashely told me that it has been 72days. I had my furnitures delivered like two days after the purchase. They broke the one of the drawers and I waited wks for replacement. And in the middle of June I called them to return the item since they can’t fix it. They told me they don’t want it cos it’s been a month. I was confused with the “72days” and “a month”. It’s a freaking scam. April 18, 2023 they delivered the items, its either Saturday or Sunday I bought the stuff. They delivered the replacement on May then June (all broken/scratched drawers) then I called. I asked for discount if they won’t accept the return, they said they can’t give a discount. No discounts for the drawer they broke when they assembled it.

    I placed order online with Ashley home store online and they took my money but yet say there’s no order in my name. My bank is conducting an investigation .

      I should have done my research about the store since people nowadays rely on reviews. I saw their advertisement online for a set of King size bedroom for $2K and when I went to the store they said it was for a kid bedroom set. I needed a bed for a house we just moved-in, I work 12hrs during the time we did the move. I was tired and Ashley was the closes one in town and I really like the bed. It has storage and it fit for the cute house we moved-in. Little did I know that Ashley will stress me out of the drawer they broke during the assembly and up until now they still haven’t given me the right drawer for my Chest. They always send a broken one or scratched and they said that it’s a unique marking for the design not a scratch. They wouldn’t give me discount or anything and when I call they hanged up on me. I ended up buying the set for more than $5K, I paid my part they want the money I gave it to them but the treatment I get and how they handle the situation left me frustrated and very much stressed out. If I could only turn back time, if I only knew this would happen to me, I would have walked out from that store, I would have rather lay on the floor that night and gone to Bob’s Furniture.
