Folgers, La-Z-Boy, American Girl class action lawsuits overview: 

  • Who: Keith Carroll filed separate class action lawsuits against La-Z-Boy Incorporated, Mattel Inc., American Girl Brands LLC, and The J.M. Smucker Company d/b/a Folgerscoffee.com. 
  • Why: Carroll separately claims La-Z-Boy, American Girl, and Folgers violate the law by allegedly secretly reporting the identities and media viewing activity of their website visitors with Facebook. 
  • Where: The class action lawsuits were filed in California federal court. 

La-Z-Boy, American Girl, and Folgers violate the law by allegedly secretly reporting the identity and media viewing activity of their website visitors to Facebook, a trio of separate new class action lawsuits allege. 

Plaintiff Keith Carroll separately argues La-Z-Boy, American Girl, and Folgers violate the Video Privacy Protection Act by secretly reporting website visitors activity to Facebook, in order to help the social media company create targeted advertisements. 

“Defendants secretly report all the details to Facebook: the visitor’s identity, the titles watched, and more. Why? So Facebook can bombard the person with more ads urging the person to buy products from Defendants,” state the American Girl and Folgers class actions. 

Facebook tracking Pixel embedded in La-Z-Boy, American Girl, Folgers websites, says class actions

Carroll claims La-Z-Boy, American Girl, and Folgers each have what is known as the Facebook tracking Pixel embedded into their websites, which he says is able to “transmit numerous distinct events to Facebook.” 

“Through the Facebook Tracking Pixel’s code, these cookies combine the identifiers with the event data, allowing Facebook to know, among other things, what … videos a user has watched,” state the La-Z-Boy, American Girl, and Folgers class actions. 

Carroll wants to collectively represent a nationwide class of consumers who watched video content on either La-Z-Boy, American Girl, and Folgers’ websites, and subsequently had their personally identifiable information disclosed by the companies to Facebook. 

Plaintiff is demanding a jury trial for each individual complaint, and collectively requesting declaratory and injunctive relief along with an award of statutory and punitive damages for himself and all class members. 

A number of similar class action lawsuits were filed against companies — including Warner Bros., BuzzFeed, GameStop, Sony, Bloomberg, Realtor.com, AMC Network, and the National Basketball Association — earlier this year over claims the companies shared the data of their subscribers with Facebook without consent.  

The complaints similarly argued that the companies were sharing the data of their subscribers with Facebook in order to help Facebook create targeted advertising
