Wyndham in Las Vegas - Wyndham timeshare

Wyndham timeshare owners have filed a class action lawsuit against the company, accusing it of lying to customers about benefits and subjecting them to aggressive marketing tactics to get them to purchase useless points.

In the most recent Wyndham Vacation Resorts class action lawsuit, timeshare owners David and Thea DuBose say the company defrauds customers both before they sign on to a timeshare and after they have already purchased one.

They claim the company touts that the timeshares are offered at attractively low prices and destinations around the world will be available to timeshare owners. However, the customers say that in reality, it is almost impossible to book a stay at one of Wyndham’s destinations, and it would be cheaper to pay cash for a vacation.

The DuBoses are Georgia residents who say they made their purchase of a Wyndham timeshare on June 23, 2016, in Florida.

They say that while they were on vacation in Panama City, Florida, a Wyndham representative offered them a gift card and encouraged them to attend a timeshare sales presentation.

They explain that they were told the meeting would last only 90 minutes, but instead, the meeting lasted almost all day.

Additionally, a Wyndham sales representative was supposedly assigned to sit with them “on a one-on-one basis” throughout their time at the resort.

Allegedly, the company made a range of fraudulent sales pitches, telling the couple they would “never have to pay for another vacation for the rest fo their lives,” and would save tens of thousands of dollars.

They say the representatives told them they would have access to resorts around the world, particularly at the new Rio Mar, Puerto Rico, resort.

The couple goes on to say they were told they would be able to leave their timeshare to their children.

They were also supposedly told they could resell their points or could make money from the points by renting them.

However, the DuBoses say the offers were misleading for a range of reasons.

They state that points expire annually if they go unused, and timeshare owners are charged maintenance fees that increase regularly. Also, significantly, using their Wyndham points is more expensive than booking a vacation through another, non-Wyndham company.

They also state that frequently, many destinations are not available to timeshare owners because most of the resort space is not given to timeshare owners to use.

The Wyndham timeshare false advertising class action lawsuit says these misrepresentations are the same ones fed to many other customers during the timeshare purchasing processes, even after they purchase.

The DuBoses cite complaints made by other customers, including customers who say they were subjected to extensive pushy sales tactics after they purchased their timeshares.

Allegedly, when they visited resort locations, the customers were required to attend “Owner Update” meeting to access certain amenities. They were allegedly told these meetings would last only 90 minutes, when they really lasted all day.

The Wyndham timeshare owners say that instead of mere updates, these meetings were an effort to get timeshare owners to shell out more money for more points or to access various amenities.

Customers say they felt cornered into buying more points and spending more money because the company made concerted efforts to prevent them from leaving the meetings, and made sure the customers had spent a certain amount of time at the meetings to receive benefits.

Previously, the DuBoses filed a class action lawsuit against Wyndham over these claims in Illinois, but it was dismissed because the court determined that the couple lacked jurisdiction in Illinois.

Now, the couple has filed in Delaware and assert that their claims are timely, per the terms of their contract with the company.

This is not the first time Wyndham has faced claims that the company misleads and takes advantage of customers.

In February, customers filed another Wyndham class action lawsuit similar to the DuBoses’.

    Add me to your class action suit. I have complained MANY times to Wyndham without any concern on the part of Wyndham to honor their contract and promises of “ go WHERE YOU WANT WHEN YOU WANT” vacations. I have records and a spread sheet of times I called, no availability, no FREE upgrades as promised ( even when they had availability). Taking secondary vacations have become our habit because we can never get what we need when we were promised FAMILY VACATIONS! Wyndham has extensive records on us and we have extensive records on Wyndham! We would love to be included in a class action lawsuit.

    I not only agree with everyones shared experiences, it is absolutely so bad with the high sales gimmicks and scams but let me add two more items. We were in Nashville in October of 2023. 1st, in registration my wife and I were bombarded for freebies. The guy in reception, we told them we were there for the Elton John Farewell concert because 50 years ago my then girlfriend that I subsequently married took this trip to commemorate our 50 years together. I told the guy in reception and that I had parking passes for the concert. He told us 2 lanes were blocked due to roadwork but he would give us 2 passes for a shuttle that would drop us off. The Shuttle dropped us off 2 miles from the venue and told us the last shuttle would leave the same place we were dropped off. My wife and I are late 60s and 70. Needless to say, the 2 mile walk each way put our health at risk. And we had to leave the concert early to make it back so they ruined our complete trip! I would also include lie they put us in wreckers endangerment because the shuttle was too small and we and others had standing room only in the shuttle. The overhead hand rail was partially missing. So we had a packed shuttle with a row of people trying to stand for about 20 miles on an interstate at 60-70 miles per hour. It was so bad I took pictures for proof including the shuttle tag number! They should be held accountable for wreck less endangerment also. We discussed with management but got no acknowledgement of the problem, then they presented us a “deal” for extra points.
    Last week, I called Wyndham about exit options because of our experiences and their sales pitch that we could exit anytime we felt we had reached our travel goals and age. Their rep said someone would call within 8 days. I heard and received from them this week letter threatening a lein and they had suspended our use until a late payment hadn’t been paid. We have no idea what they were claiming as late and they said we had signed an additional contract and owed almost 15k. I would join with other members to own them!!!

    I attend the Wyndham presentation and was pressured into buying a Wyndham bought it then then cancelled within 24hrs of buying found out they open credit card in my name trying to close it down and it’s useless a whole bunch of dead end.. then almost a month after they opened a credit card in my fiance name without any consent or authorization. This place is a joke and fraud. Add me to this class action lawsuit.

    Hello. My wife and I have been “owners” at Wyndhams since and before it was even known as Wyndham… back to the days of Fairfield and we have watched Wyndham transform what was a customer focused company to more of what is now a nickel and dime “for whatever Wyndham can get out of the owner” type company. We take issue with the ever growing monthly maintenance and taxes…sure. But what bothers us mostly is the rediculous effort that Wyndhams so called sales staff will go to bleed the “owners” out of even more money by telling them during a “check in” process that we need to be updated on the “new processes” within Wyndham for “how to use the newest website” or perhaps “the newest system for booking” or whatever the lated movationational or manipulative reasoning is… in order TO GET THE OWNER TO A 90 MINUTE “UPDATE”. Lol! I’m sorry. I’m a good person but Wyndham’s business model for business growth for 2023 absolutely and obviously SUCKS! And that’s just putting it mildly. Wyndham’s sales team is like a trained group of monkeys in a circus. Any owner with any sense sees their pattern. Wyndham’s only objective is more money. They don’t value pleasing the current owners. They are only pressure driven sales. Our most recent experiences at Wyndhams in Smoky Mountains Sevierville and Ocean View in Myrtle Beach were disasters! The sales teams were like mob agents with a vengeance and one goal. Customer relations and pleasing the owner was irrelevant and intimitation to make a sale was paramount. Yes, parking tags were held from us until we spoke with these high pressure sales people.

    We joined when pregnant and found out within a month that we could not sell/rent our points like we were told. Loans and mortgage amount lied about and then we got bed bugs. Meanwhile after our first trip within a month and we tried to get answers but got none. Then we were told our baby would be born terminal, diagnosed with Trisomy 18. We were also informed our toddler would need heart surgery. “Oh, you definitely can qualify for a Wyndham Exit!” We were promised this and in the meantime kept paying but finally quit after 5 months of no answers as to our Exit. Finally, a denial and no reason as to why but yet we sent in over $250k in heart surgery bills and that was before our son passed away three weeks ago.
    Wyndham disgusts me. I’m a veteran, a mother and of all of the business practices and places to vacation I’d have loved to use Wyndham but not after wrecking our credit and families financial future via fraud and deception. I think that Wyndham targets elderly and disabled people.

    My husband and I have had the same experience very high & forceful sales tactics with Wyndham and causes us to be in excessive debt. They have lied about timeshare and other Wyndham tactics to get you to sign.
