Wyndham in Las Vegas - Wyndham timeshare

Wyndham timeshare owners have filed a class action lawsuit against the company, accusing it of lying to customers about benefits and subjecting them to aggressive marketing tactics to get them to purchase useless points.

In the most recent Wyndham Vacation Resorts class action lawsuit, timeshare owners David and Thea DuBose say the company defrauds customers both before they sign on to a timeshare and after they have already purchased one.

They claim the company touts that the timeshares are offered at attractively low prices and destinations around the world will be available to timeshare owners. However, the customers say that in reality, it is almost impossible to book a stay at one of Wyndham’s destinations, and it would be cheaper to pay cash for a vacation.

The DuBoses are Georgia residents who say they made their purchase of a Wyndham timeshare on June 23, 2016, in Florida.

They say that while they were on vacation in Panama City, Florida, a Wyndham representative offered them a gift card and encouraged them to attend a timeshare sales presentation.

They explain that they were told the meeting would last only 90 minutes, but instead, the meeting lasted almost all day.

Additionally, a Wyndham sales representative was supposedly assigned to sit with them “on a one-on-one basis” throughout their time at the resort.

Allegedly, the company made a range of fraudulent sales pitches, telling the couple they would “never have to pay for another vacation for the rest fo their lives,” and would save tens of thousands of dollars.

They say the representatives told them they would have access to resorts around the world, particularly at the new Rio Mar, Puerto Rico, resort.

The couple goes on to say they were told they would be able to leave their timeshare to their children.

They were also supposedly told they could resell their points or could make money from the points by renting them.

However, the DuBoses say the offers were misleading for a range of reasons.

They state that points expire annually if they go unused, and timeshare owners are charged maintenance fees that increase regularly. Also, significantly, using their Wyndham points is more expensive than booking a vacation through another, non-Wyndham company.

They also state that frequently, many destinations are not available to timeshare owners because most of the resort space is not given to timeshare owners to use.

The Wyndham timeshare false advertising class action lawsuit says these misrepresentations are the same ones fed to many other customers during the timeshare purchasing processes, even after they purchase.

The DuBoses cite complaints made by other customers, including customers who say they were subjected to extensive pushy sales tactics after they purchased their timeshares.

Allegedly, when they visited resort locations, the customers were required to attend “Owner Update” meeting to access certain amenities. They were allegedly told these meetings would last only 90 minutes, when they really lasted all day.

The Wyndham timeshare owners say that instead of mere updates, these meetings were an effort to get timeshare owners to shell out more money for more points or to access various amenities.

Customers say they felt cornered into buying more points and spending more money because the company made concerted efforts to prevent them from leaving the meetings, and made sure the customers had spent a certain amount of time at the meetings to receive benefits.

Previously, the DuBoses filed a class action lawsuit against Wyndham over these claims in Illinois, but it was dismissed because the court determined that the couple lacked jurisdiction in Illinois.

Now, the couple has filed in Delaware and assert that their claims are timely, per the terms of their contract with the company.

This is not the first time Wyndham has faced claims that the company misleads and takes advantage of customers.

In February, customers filed another Wyndham class action lawsuit similar to the DuBoses’.

    How can I talk to someone about this. My experience with Wyndham has been a nightmare and the signatures on the contract are not mine! I’m so confused because nothing on the contract is the same as it was in the talks in person. We also bought tickets through them (at an information booth) and didn’t realize it was through Wyndham! They refused to give us tickets we paid full price for until we went to a meeting! Then we did and they had us sitting for over 5 hours until they could push us to buy!

      Im having the same problem, they charged me, on crédit card the down payment without my autorization, but they used a Electronic signature for this charged.

    19+ years of ownership. One of the more clever things they do, is just tell you what you want to hear so you will “go away.” 19+ years of ownership, and have NEVER been able to utilize my timeshare, RCI points, nothing. 19+ years of nothing, except for “legal theft” from Wyndham after they bought Fairfield and of course frustration. Stress manifests in various ways when it comes to individual health. I wish a price tag could be placed on that. I have a 19+ year story….who wants to hear it? No one. I’d bet over 100,000 people have a very similar story.

    Club WYNDHAM Plus is a scam. We bought in 2004 and now “they” have changed their rules and regulations so much the representatives can’t tell you what they are. I have pages of documentation, and am able to support my claims that they cannot fill their promises. We have three deeds and owe them nothing but a high maintenance every month, which increases every year. It is going to cost us thousands to transfer deeds to our children, which should not happen according to their old rules and regulations. Every time we have to deal with my our blood pressure goes high. Now as we are typing this, we have been holding for 30 minutes to tell them that they charged us for three maintenance amounts in less than a month on our credit card. Can’t book a nice vacation for our family this year because of lack of availability. We have seen and heard too much garbage since 2004. It is a shame that they have forgotten about integrity.

    We are trying to get out of our time share as my husband has ms and is not able to travel which they told us they have a medical exit at the time. I have contacted them and they they would like to talk over the phone I have asked to do in writing I don’t trust them.
    Being seniors on a fixed income we can’t afford this especially as it it is USD funds. Please help

    I have had the same experience for years. The day my husband signed the contract just to get out of there – it was more than 4 hours – he was not well and just kept asking for something to drink. They promised the work but never provided him anything. No water no aspirin nothing. Very poor experience.! How to I sign up for this class action law suit?

    My wife, Connie and I have had the same kind of experience with Wyndham add us to the class action lawsuit
    Among the flat out lies:
    1-all other fees other than club Wyndham fess would go away, they did not
    2-We would have a single point of contact for all our vacation ownership needs, because Wyndham now owns our other time share, RCI. False, in fact we now have a more complex system, and have never been able to use Wyndham points, only the same RCI system we have used for years
    3-we could reserve and rent resort time for cash back, and our one point of contact would take care of it all, with minimal effort from ourselves. Again, flat out lies, we Did in fact manage to contract a couple resort stays, had to manage it all ourselves, and still have never received any cash back. Total Fraud!

      I would love to join a class action, make them be more accountability for all the Hugh lies!!! They riped me off good and I plan on fighting back. Should not be aloud to lie & take advantage. They said I could not close without my husband. All they said was a lie & I am so upset, I told them not to lie to me what a joke. Not sure why any company wants to be so shady. Sad, I am furious!

        Same happen to us, they said our credit was not going to be affected and they went ahead and open a credit card without our approval and now we cannot buy our home.

    All the above dubious, doubtful and untrue exaggerations were used on us when Wyndham used the same pressure sales techniques for us to buy into their timeshare fraud in May 2019.
    We live in Australia and do not have access to such a class action and would dearly like to be included in this class action if it is at all possible.
