Tampax class action lawsuit overview:

The Procter & Gamble Company faces a new Tampax class action lawsuit claiming it falsely advertises tampons as being free of dyes even though they contain titanium dioxide, which is a variety of uses but can be used as a pigment.

Plaintiff Rene Strano points to the labels on several Tampax tampons products which prominently state they are “Free of Dyes.” The products named in the Tampax class action lawsuit include Tampax Cardboard, Pearl and Radiant sub-brands.

“Though it may be literally true that the tampons are ‘Free of Dyes,’ this statement is misleading because [Tampax tampons contain] titanium dioxide, a synthetically prepared powder used as a white pigment,” the Tampax class action lawsuit says.

Strano alleges the use of titanium dioxide serves an identical purpose as dyes and is used primarily for the appearance, not the efficacy, of Tampax tampons.

Plaintiff: P&G charged premium for falsely advertised ‘Tampax Free of Dyes’ tampons

The “Tampax Free of Dyes” language appeals to consumers looking for tampons without added coloring or dyes, according to the Tampax class action. The alleged misrepresentation also allows P&G to charge higher prices for the Tampax tampons than it would without the Tampax Free of Dyes claim, Strano alleges in the Tampax Free of Dyes class action.

In her case, Strano says she read and relied on the “Tampax Free of Dyes” claim on the product label and decided to purchase Tampax tampons over similar products that allegedly did not misrepresent their components.

Strano says she paid more for the Tampax tampons than she would have absent the misleading “Tampax Free of Dyes” statement.

She filed the Tampax class action lawsuit on behalf of a proposed class of individuals in New York who purchased Tampax Free of Dyes products during the applicable statute of limitations period.

The Tampax tampons class action asserts claims for violation of New York business law and unjust enrichment.

A California federal judge recently dismissed a class action lawsuit alleging o.b. Organic Tampons contain harmful forever chemicals.
