Sunpro Solar phone calls class action lawsuit overview: 

  • Who: Tanisha Tutson filed a class action lawsuit against Sunpro Solar Inc. 
  • Why: Tutson claims Sunpro Solar unlawfully contacted consumers with unsolicited phone calls. 
  • Where: The Sunpro Solar class action lawsuit was filed in California federal court. 

Solar panel company Sunpro Solar unlawfully placed unsolicited phone calls to consumers, including those with numbers listed on the National Do Not Call Registry, a new class action lawsuit alleges. 

Plaintiff Tanisha Tutson’s class action lawsuit claims Sunpro Solar violated the Telephone Consumer Protection Act (TCPA) by placing phone calls without having prior express written consent and to phone numbers on the National Do Not Call Registry. 

“Defendant willfully or knowingly allowed telemarketing calls to be placed to Plaintiff’s and the Class Members’ cellular telephone numbers on the National Do-Not Call Registry,” the Sunpro Solar class action says. 

Tutson is seeking to represent a nationwide class of consumers who received a promotional phone call from Sunpro Solar in the last four years that used a pre-recorded or artificial voice and who did not give the company prior express written consent. 

The plaintiff also wants to represent a nationwide class of consumers who received more than one telephone solicitation call from Sunpro Solar within the past four years on a number listed on the National Do Not Call Registry for at least 31 days. 

Sunpro Solar class action: Company ‘failed to respect’ limitations imposed by TCPA

Tutson argues in the Sunpro Solar phone calls class action that she received several unsolicited telemarketing phone calls placed by Sunpro Solar to her number listed on the National Do Not Call Registry, all without her prior express invitation or express written consent. 

“When Defendant made such calls to consumers without their consent and/or with prerecorded voices, and made calls to telephone numbers on the National Do-Not-Call Registry, Defendant failed to respect the limitations imposed by the TCPA,” the Sunpro Solar class action says. 

In addition to allegedly violating the TCPA, Tutson claims Sunpro Solar invaded the privacy of herself and thousands of other consumers nationwide. 

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of statutory and treble damages for herself and all class members. 

Two other class action lawsuits alleging TCPA violations were filed in January against Carvana and Bath Fitter, respectively.
