A class action claims that the herbal aphrodisiac Cavalier Gentlemen’s Product is misrepresented to deceive consumers about its efficacy.
The Cavalier Gentlemen’s Product is an over-the-counter supplement sold by Nutrabolt which is reportedly intended to help with sexual performance issues.
Unfortunately, the pseudo-drug is reportedly ineffective as none of the ingredients in the supplement have an impact on male sexual performance, according to the Cavalier Gentlemen’s Product class action.
Plaintiff Andrew Harris claims that he and other consumers were deceived into purchasing the sexual health supplement based on false representations from Nutrabolt.
The supplement is reportedly composed of a variety of herbs, roots, and other organic substances. Nutrabolt claims that these ingredients are “traditionally” used to promote sexual health and have “been shown to increase libido.” According to Harris, these representations are false.
“None of the ingredients in Cavalier, individually or in combination, can provide such benefits. Several of the ingredients the FDA has singled out by name []as being unlawfully used in purported herbal aphrodisiacs.”
In fact, the products are allegedly risky to human health due to their yohimbe content. This extract is reportedly cautioned against by the National Institute of Health due to its influence on mental health and blood sugar. Harris argues that these risks are undisclosed by Nutrabolt.
The product is further misrepresented in terms of the instructions as it reportedly suggests that it could be taken daily and “30 to 45 minutes prior to sexual activity” in order to promote “sexual health.”
The Cavalier Gentlemen’s Product class action claims that the tablet instructions intentionally mimic instructions on FDA approved drugs used for erectile disfunction. The instructions on the Cavalier Gentlemen’s Product allegedly cause consumers to believe that their products are effective.
Harris argues that the statements made by Nutrabolt qualify the Cavalier Gentlemen’s Product as an unauthorized drug. The supplement reportedly does not have FDA approval to make such claims which places it in violation of the Food, Drug, and Cosmetics Act (FDCA).
“The FDCA requires any new drug to have an application approved by the Food and Drug Administration (FDA) before the drug can be marketed to the public, and further that the drug’s label be approved by the FDA prior to marketing or selling the drug to the public,” Harris argues in his Cavalier Gentlemen’s Product class action.
The plaintiff says he and other consumers would not have purchased the product or would not have paid as much had they been aware that Nutrabolt used misleading and deceptive statements in the labeling and marketing of the Cavalier Gentlemen’s Product.
In the Cavalier Gentlemen’s Product class action lawsuit, Harris seeks to represent a Class of consumers who purchased the product since Jan. 1, 2015.
