Halloween candy recall overview:

  • Who: Crystal Temptations is recalling its Halloween Chocolatey Eyeballs, affecting multiple packaging styles.

Crystal Temptations is recalling its Halloween Chocolatey Eyeballs due to the presence of undeclared milk allergens. The recall affects several states, including Arizona, California and Texas, among others.

The Halloween candy recall affects five different packaging styles of the Chocolatey Eyeballs, identified by specific style numbers. These include a 10 oz. plastic bag, a 7 oz. acrylic box, a 10.5 oz. round plastic jar, a 16 oz. designer plastic pouch and an 11 oz. plastic bag tied with a tag.

The issue arose when a TJX analyst found that the packaging did not disclose the presence of milk, specifically whey, which could pose a serious risk to individuals with milk allergies.

“Subsequent investigation indicates the problem was caused by a temporary breakdown in the company’s production and packaging processes,” the U.S. Food and Drug Administration noted.

Consumers with milk sensitivities warned not to consume affected candies

The recall notice emphasizes the potential danger to consumers with milk allergies. “People who have an allergy or severe sensitivity to milk run the risk of a serious or life-threatening allergic reaction if they consume these products.”

Crystal Temptations is urging consumers who purchased the recalled Halloween candies to destroy the product and not to consume it.

Refunds are not available at the point of sale. Consumers must reach out to Crystal Temptations with proof of purchase for a refund. They can contact the company directly at 1-201-246-7990, Monday through Friday, from 9:00 a.m. to 5:00 p.m. Eastern Time, with proof of purchase to receive a refund.

Crystal Temptations says it has not received any reports of illness related to the recall so far. The company is not currently facing legal action over the Halloween candy recall, but Top Class Actions follows recalls closely as they sometimes lead to class action lawsuits.

In other candy-related news, KIND is facing a class action lawsuit claiming its granola clusters contain more than four times Proposition 65’s maximum allowable dose level of lead per day.
