VSL Pharmaceuticals has agreed to a $20 million class action settlement to resolve claims it falsely advertised the VSL#3 probiotic as clinically proven to treat certain medical conditions.
The VSL#3 settlement benefits consumers who purchased VSL#3 in the United States between June 1, 2016, and June 19, 2019.
Plaintiffs in the class action lawsuit claim VSL Pharmaceuticals falsely advertised the VSL#3 probiotics as clinically proven to treat certain medical conditions. As a result of this false advertising, consumers allegedly overpaid for the product.
VSL Pharmaceuticals has not admitted any wrongdoing but agreed to a $20 million class action settlement to resolve these allegations.
Under the terms of the class action settlement, class members can receive a cash payment based on the number of units of VSL#3 they purchased.
Class members who do not have proof of purchase can claim one unit of VSL#3 purchased and receive a payment of up to $20.
Class members with proof of purchase can claim up to 40 units of VSL#3 and receive a payment of up to $800. Exact payments will vary depending on the number of units claimed and the number of claims filed with the settlement.
The deadline for exclusion and objection is Oct. 20, 2026.
The final approval hearing for the VSL#3 settlement is scheduled for Jan. 6, 2027.
To receive settlement benefits, class members must submit a valid claim form by Oct. 20, 2026.
