Edikted class action lawsuit overview:

A new class action lawsuit accuses women’s online fashion retailer Edikted of deceptively adding junk fees to consumers’ shopping carts.

Plaintiff Marisa Scola and two other consumers filed the class action complaint against Edikted on Aug. 31 in California federal court, alleging violations of state consumer and business laws.

According to the Edikted class action lawsuit, the company adds a so-called “Shipping Protection” fee to consumers’ orders without their consent despite advertising free or paid shipping based on the order value.

The plaintiffs claim the fee is automatically included in the shopping cart during checkout and provides no real benefit to consumers, who would not knowingly choose to pay it.

“Thousands of e-commerce customers [like plaintiffs] have been assessed hidden shipping charges for which they did not bargain due to Edikted’s deceptive tactics,” the Edikted class action lawsuit says.

Class action: Edikted shipping protection fee is ‘worthless’

The class action lawsuit claims that Edikted’s “Shipping Protection” fee is a junk fee that does not add value to the consumer. 

The plaintiffs argue the fee is related to the shipping of the purchased products and any returns or exchanges, making the promise of free or flat-rate shipping misleading.

They claim the fee is inaccurately named and described, as it offers no additional protection for shipments beyond what is already provided by most retailers and shipping services.

The class action lawsuit alleges that the fee is entirely worthless for consumers shipping products valued at less than $100, as popular shipping services like UPS and FedEx already include insurance for the first $100 worth of value in a package.

The plaintiffs are looking to represent anyone who paid a shipping protection fee to Edikted within the applicable statute of limitations.

They are suing for violations of California’s Unfair Competition Law, False Advertising Law and Consumers Legal Remedies Act as well as breach of contract and unjust enrichment. The plaintiffs seek certification of the class action, damages, fees, costs and a jury trial.

Meanwhile, women’s activewear brand Popflex and its returns processor, Redo Tech, are also accused of tricking customers into paying a hidden junk fee for a service they do not need.
