Managed Care of North America (MCNA) has agreed to a class action settlement to resolve claims it failed to prevent a 2023 data breach that compromised sensitive consumer information.

The MCNA settlement benefits individuals who received a data breach notice from MCNA informing them that their personal and medical data may have been compromised in a cyberattack between Feb. 26 and March 7, 2023.

The MCNA data breach compromised sensitive information, such as names, addresses, birth dates, Social Security numbers, driver’s license numbers, health insurance information, Medicaid and Medicare ID numbers, dental and orthodontic care information and more.

Affected consumers filed a class action lawsuit against MCNA, claiming the company failed to prevent the data breach through reasonable cybersecurity measures.

MCNA is a third-party dental benefits administrator that oversees oral health coverage contracts for state Medicaid agencies, Medicare beneficiaries and the children’s health insurance programs.

MCNA has not admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the data breach class action lawsuit.

Under the terms of the MCNA settlement, class members can receive two years of free medical data monitoring services.

Class members can also receive a cash payment of up to $2,500 for documented out-of-pocket losses related to fraud or identity theft. These losses must be fairly traceable to the MCNA data breach and must have occurred after the data breach and before March 7, 2026.

The MCNA settlement does not provide an alternative cash payout for class members.

The deadline for exclusion and objection is Oct. 19, 2026.

The final approval hearing for the MCNA settlement is scheduled for Nov. 16, 2026.

To receive settlement benefits, class members must submit a valid claim form by Oct. 19, 2026.


Who’s Eligible

The class action settlement benefits individuals who received an MCNA data breach notice informing them that their information may have been compromised in a data breach that occurred between Feb. 26, 2023, and March 7, 2023.

Potential Award

Up to $2,500 in documented losses

Proof of Purchase

Claimants must provide documentation generated by a third party supporting their claim, such as telephone records, correspondence or receipts. Personal certifications, declarations or affidavits do not constitute proper documentation but may be included to provide clarification, context or support for other submitted reasonable supporting documentation.
