What is the nitrous oxide abuse lawsuit investigation about?

Attorneys are reviewing potential legal claims involving nitrous oxide products — commonly known as whippets — following reports of serious neurological injuries, impaired driving incidents and other catastrophic harm allegedly connected to nitrous oxide use.

These claims argue that:

  • Nitrous oxide abuse is linked to serious neurological injuries and other catastrophic harm
  • Whippets were marketed and distributed in ways that made misuse foreseeable
  • Nitrous oxide impairment contributed to preventable accidents and injuries involving innocent third parties
  • Individuals and families suffered devastating physical, emotional and financial consequences connected to nitrous oxide use

If you or someone you love was seriously harmed by nitrous oxide, you may be able to seek compensation for property damage, physical injury, medical expenses, pain and suffering, and more.

Who qualifies for the nitrous oxide lawsuit investigation?

The nitrous oxide lawsuit investigation is currently focused on two groups of people: individuals who suffered serious injuries after using whippets and people who were injured by someone allegedly under the influence of whippets.

You may qualify for the whippet abuse lawsuit if the following applies:

  • You suffered a serious neurological injury that required hospitalization after using nitrous oxide, and
  • You have documentation showing nitrous oxide use, such as purchase receipts or related records

Or you may qualify if:

  • You or a loved one were seriously injured or killed by someone allegedly under the influence of nitrous oxide
  • The injuries required hospitalization or resulted in death, and
  • There is documentation supporting nitrous oxide impairment, such as a police report or toxicology records

Time limits may apply. Do not wait to check whether you may qualify.

How whippet abuse can create lasting harm for users and others

Nitrous oxide use has been linked to devastating consequences for both users and innocent third parties. In many cases, the physical, emotional and financial effects can continue long after the initial injury or accident.

  • Financial Hardship: Serious injuries often leave individuals and families facing overwhelming medical bills, lost income, reduced earning capacity, rehabilitation costs and ongoing financial uncertainty.
  • Long-Term Disability: Some people who suffer neurological injuries after using nitrous oxide experience lasting complications. In some instances, these individuals face months or years of rehabilitation — and some never fully recover.
  • Emotional Trauma: Catastrophic injuries and sudden loss can leave lasting emotional scars on victims and families. Many people struggle with grief, anxiety, depression and the emotional toll of adapting to life after a serious injury or fatal accident.
  • Loss of Life: Fatal nitrous oxide-related incidents can leave families coping with emotional suffering, financial strain and the long-term effects of a sudden loss.

If you or a loved one experienced serious harm connected to nitrous oxide use or a nitrous oxide-related accident, you may qualify to pursue compensation as part of a whippet lawsuit. Complete the form on this page to find out whether you may be eligible to take legal action.

What are whippets, and why are they dangerous?

Whippets — also referred to as whippits and Whip Its! — are small metal canisters filled with nitrous oxide gas. Commonly used in food preparation, these cartridges are inexpensive, widely available and legal to purchase in many states.

When inhaled recreationally, nitrous oxide can produce a short-lived feeling of euphoria, dizziness and disorientation. Because of these effects, whippets have become one of the most commonly misused inhalants in the United States.

Although some people view nitrous oxide as a relatively harmless high, misuse of these products has been linked to serious and potentially permanent injuries. Nitrous oxide can reduce oxygen flow to the brain, increasing the risk of loss of consciousness, neurological damage and catastrophic brain injury.

Repeated nitrous oxide use may also interfere with the body’s ability to process vitamin B12, which plays an important role in nervous system function. In some cases, this can lead to severe nerve damage, loss of mobility, cognitive impairment and long-term disability.

The dangers of nitrous oxide abuse may also extend beyond the user. Impairment linked to nitrous oxide has been associated with serious car accidents, traumatic injuries and fatal incidents involving innocent third parties.

Nitrous oxide can impair judgment, coordination, reaction time and decision-making — all abilities drivers rely on to operate a vehicle safely. Even short-term impairment may increase the risk of serious accidents.

Unlike alcohol, there is currently no roadside test specifically designed to detect nitrous oxide impairment. Even so, police reports, toxicology findings and other evidence have been used to help establish whether nitrous oxide abuse may have contributed to a crash or other serious incident.
