Kelly & Associates Insurance Group agreed to a $5 million class action settlement to resolve claims it failed to prevent a 2024 data breach that compromised sensitive consumer information.
The Kelly Benefits settlement covers individuals whose private information was compromised in the Kelly & Associates Insurance Group data breach between Dec. 12 and 17, 2024.
According to the data breach class action lawsuit, Kelly & Associates failed to implement adequate cybersecurity measures to protect consumer information. The company could have prevented the breach with reasonable cybersecurity, the plaintiffs contend.
Kelly & Associates Insurance Group, also known as Kelly Benefits, is a benefits and insurance company specializing in group health insurance administration, brokerage, consulting, human resources information systems and integrated payroll solutions.
Kelly & Associates has not admitted any wrongdoing but agreed to a $5 million class action settlement to resolve the data breach class action lawsuit.
Under the terms of the Kelly Benefits settlement, class members can receive up to $5,000 for documented monetary losses related to the data breach. These losses can include credit monitoring costs, unreimbursed fraud or identity theft losses, bank fees, communication charges and travel expenses. Class members must provide documentation of these losses to receive reimbursement.
Class members can also receive a pro rata cash payment from the Kelly Benefits data breach settlement. These payments are estimated to be around $50 but will vary depending on the number of claims filed with the settlement.
All class members are eligible for three years of free credit monitoring. This benefit includes dark web monitoring, identity theft insurance coverage of $1 million and fully managed identity recovery services.
Class members with a California address on Dec. 12, 2024, may be eligible for an additional statutory payment of up to $100. This payment is intended to compensate class members for the additional protections offered to California residents under the California Consumer Privacy Act.
The deadline for exclusion and objection is Nov. 27, 2026.
