Meta Platforms is facing a class action lawsuit alleging its Meta AI Glasses wiretap the conversations of consumers.
Plaintiff Angelo Subia filed the class action lawsuit against Meta on Oct. 19 in California federal court, alleging violations of the California Invasion of Privacy Act.
According to Subia, the Meta AI Glasses are designed to be wearable AI assistants that provide wearers with answers to questions and commentary on what they see throughout the day. The Meta glasses are also meant to assist with day-to-day activities like responding to messages and receiving phone calls.
The Meta glasses are supposed to be triggered by the phrase โHey Meta,โ which activates the microphone, camera and AI software, Subia claims. However, the lawsuit alleges Meta glasses activate, listen to and record conversations even when the user does not say the trigger words.
Meta did not disclose Meta AI Glasses would record all conversations
After purchasing a pair of Meta AI Glasses in January 2026, the plaintiff claims to have worn them daily while having numerous conversations, including sensitive, personal matters with family, friends, doctors and financial institutions.
Subia claims the product listened to and recorded conversations even when it was not intentionally activated, with the communications allegedly stored in the userโs account Voice Activity Log.
The class action lawsuit argues the plaintiff trusted Meta AI Glasses would only record communications when triggered and that Meta did not provide affirmative consent to record private conversations outside of the product’s activation.
Subia is suing for violations of the California Invasion of Privacy Act. The plaintiff seeks to represent a class of all California residents who purchased the Meta AI Glasses and had their communications recorded without using the trigger words.
The plaintiff is seeking an order certifying the Meta class action lawsuit, an order declaring Metaโs conduct violates the law, compensatory and statutory damages, prejudgment interest, injunctive relief and an award of attorneysโ fees and costs.
In a related class action lawsuit, two consumers are suing Meta Platforms for allegedly failing to disclose that its AI smart glasses transmit videos to third-party contractors for human review.
