Progressive County Mutual Insurance Company agreed to an $8 million class action settlement to resolve claims it failed to pay timely interest on medical bills submitted for personal injury protection (PIP) benefits.
The Progressive settlement benefits individuals who submitted a covered medical bill under their PIP coverage for a Texas-based policy and Progressive paid and issued an explanation of benefits (EOB) for a line item on the bill more than 15 or 30 business days after receiving the bill, with an EOB print date between Aug. 30, 2016, and June 1, 2026.
Progressive is an insurance company that offers a variety of policies, including auto, motorcycle, RV, boat, homeowners and renters insurance.
According to a class action lawsuit, Progressive failed to pay timely interest on medical bills submitted for PIP benefits within the statutory deadlines required by Texas law. The plaintiffs say that they and other Progressive customers are owed interest for the late payments.
Progressive has not admitted any wrongdoing but agreed to pay an $8 million class action settlement to resolve the allegations.
Under the terms of the Progressive settlement, class members can receive a cash payment based on an objective formula using Progressive’s existing PIP billing data.
For 15-day class members, payments will be equal to 11.452% annual interest based on the 15-business-day interest days and the line item’s allowed amount.
For 30-day class members, payments will be a flat rate of 5% of the line item’s allowed amount, plus 11.452% annual interest based on the 30-day interest days and the line item’s allowed amount.
Class members who qualify for both the 15-day and 30-day classes will receive two-stage payments. The first stage will include 11.452% interest for the period between the 15th business day and the 30th day. The second stage will include the 5% flat rate, plus 11.452% interest for the remaining period from the 30th day until the date the EOB was printed.
The deadline for exclusion and objection is Nov. 12, 2026.
The final approval hearing for the Progressive settlement is scheduled for Dec. 17, 2026.
To receive settlement benefits, class members must submit a valid claim form by Jan. 19, 2027.
