Johnson & Johnson agreed to a $4.7 million class action settlement to resolve claims that it violated Illinois privacy laws by collecting biometric data from its Skin360 app without consent.
The Neutrogena settlement benefits individuals who performed a Skin360 skin assessment using any version of the app, including Neutrogena Skin360, NeoStrata Skin360 or any Skin360 collaboration with another entity via mobile application or web application while in Illinois between Dec. 9, 2019, and May 5, 2023.
Plaintiffs in the class action lawsuit claim that Johnson & Johnson violated Illinois’ Biometric Information Privacy Act (BIPA) by collecting, storing, disclosing and profiting from biometric facial geometry from its Neutrogena skin app without first providing legally required written disclosures and obtaining written consent. BIPA applies to all biometric data collected in Illinois, including fingerprints, eye scans and facial geometry scans, such as those collected by the skincare app.
Johnson & Johnson is a consumer health company that sells skincare products under the name Neutrogena and other brands.
Johnson & Johnson has not admitted any wrongdoing but agreed to a $4.7 million class action settlement to resolve the BIPA allegations.
Under the terms of the Neutrogena settlement, class members can receive a cash payment. Exact payment amounts will vary depending on the number of claims filed with the settlement and the net settlement fund after deductions for fees and other expenses.
Johnson & Johnson also agreed to delete any images obtained during skin assessments and maintain a BIPA-compliant user notice and written consent mechanism going forward.
The deadline for exclusion and objection is Nov. 10, 2026.
The final approval hearing for the Neutrogena settlement is scheduled for Dec. 17, 2026.
Class members who wish to receive a settlement payment must submit a valid claim form by Nov. 25, 2026.
