Fairmont Federal Credit Union agreed to pay more than $1.7 million as part of a class action settlement to resolve claims it failed to prevent a 2023 data breach.
The Fairmont Federal Credit Union settlement benefits individuals whose private information was potentially impacted in the Fairmont Federal Credit Union data breach between Sept. 30 and Oct. 18, 2023.
According to the class action lawsuit, Fairmont Federal Credit Union failed to prevent a 2023 data breach that compromised sensitive information of more than 187,000 consumers. The credit union allegedly could have prevented the breach through reasonable cybersecurity measures.

Under the terms of the Fairmont Federal Credit Union settlement, class members can receive up to $7,500 for out-of-pocket expenses related to the data breach. This reimbursement covers bank fees, communication charges, credit expenses, identity theft costs and more. Class members can also claim up to four hours of lost time at a rate of $35 per hour, for a maximum lost time payment of $140.
Class members who did not experience any data breach-related expenses can receive an alternative cash payment of up to $150.
All class members can receive three years of free credit monitoring and identity restoration services, including $1 million in identity theft insurance.
The deadline for exclusion and objection is Dec. 18, 2026.
The final approval hearing for the Fairmont Federal Credit Union data breach class action settlement is scheduled for Feb. 8, 2027.
