Milliman has agreed to pay $15.5 million to resolve a nationwide class action lawsuit claiming its IntelliScript reports gave life insurers inaccurate health information.
The plaintiffs asked a federal judge to preliminarily approve the unopposed FCRA settlement. Under the Fair Credit Reporting Act, companies like Milliman must keep reports accurate, disclose full files on request and reinvestigate disputes within 30 days.
Plaintiff James Healy claims in the class action lawsuit that Millimanโs flawed matching procedures placed an unrelated personโs records on his report, leading an insurer to deny him coverage. The error flagged Healy as having serious medical conditions despite his otherwise good health.
Plaintiff Jessica Brown claims an inaccurate consumer report cost her life insurance coverage. โBrown alleges that Milliman mixed her file and medical history with those of a different โJessica Brownโ who had a different middle initial and lived in a different state,โ the motion says.
Milliman denies the allegations and other claims but agreed to a class action settlement that covers about 780,965 U.S. residents in three classes through June 30, 2026.
The โinaccuracy classโ covers consumers whose Milliman report, sold since Oct. 5, 2015, included a medium- or high-risk medical or prescription record tied to a Social Security number differing from theirs by more than two changes.
The โreinvestigation classโ includes consumers who disputed a report since Oct. 5, 2015, and received Milliman’s form response or whose dispute was not resolved on time starting December 2023.
The โfile disclosure classโ covers consumers who requested their files on or after March 23, 2018, and received disclosures missing information about their sources or, during later periods, other report information or criminal history shared with third parties.
Inaccurate life insurance report claimants could receive $30 to $1,000 based on points system
The class action settlement creates a non-reversionary fund, meaning no money returns to Milliman. About $9 million will go to class members who submit valid claims.
Payments follow a points system: one point for file disclosure, three for reinvestigation and five for inaccuracy claims. Inaccuracy claimants matched by the same procedure as Healy, or with a mismatched last name and birth date, receive 20 points.
Class counsel estimates payments will range from $30 to $1,000, depending on the number of claims filed.
Milliman also agreed to keep enhanced practices for at least five years, including automated mismatch checks, better dispute tracking and disclosure of reports compiled within two years of a request.
Class members will be notified by email or postcard and have at least 60 days to file a claim online or by mail.
