A new class action lawsuit accuses Apple of overcharging consumers to cover the cost of tariffs imposed by the Trump administration while benefiting from tariff refunds.
Plaintiffs Joseph Mirabelli and Louis Gonzalez III filed the class action lawsuit against Apple on Oct. 23 in New York federal court, alleging violations of state and federal consumer laws.
According to the tariff lawsuit, Apple unfairly passed on the cost of tariffs imposed by the Trump administration to consumers, leading to inflated prices for its products.
The lawsuit claims Apple collected hundreds of millions of dollars in unlawful tariffs from consumers by raising prices on both imported and U.S.-sourced goods while the tariffs were in effect.
It alleges Apple is now receiving an inequitable windfall by recovering tariff costs from the federal government that it had already passed on to consumers.
Lawsuit: Apple passed tariff costs on to U.S.-sourced goods
The Apple class action lawsuit argues that the Trump administration imposed tariffs on imports from China, Canada and Mexico in early 2025, citing drug trafficking and the American trade deficit as justifications.
The lawsuit continues that Apple subsequently raised prices across its product line, including on U.S.-sourced goods that were not subject to the tariffs. As a result, consumers who purchased U.S.-sourced goods from Apple bore a portion of the tariff costs incurred on imported goods.
The U.S. Supreme Court struck down the tariffs in February 2026. Apple reportedly applied for and received tariff refunds from the federal government. However, the class action lawsuit alleges that Apple has not returned any portion of those costs to consumers.
The plaintiffs are looking to represent anyone who purchased an Apple product between February 2025 and February 2026 at a price increased to cover the cost of International Emergency Economic Powers Act (IEEPA) tariffs.
The tariff lawsuit seeks a judgment requiring Apple to return all IEEPA duties passed on to customers in the form of higher prices, with interest. It also seeks restitution of the overcharges consumers paid, or a proportionate share of any tariff refund Apple recovers, together with interest, attorneysโ fees and costs.
Apple is also facing accusations it falsely advertised its Safari browser as protecting users from online tracking while allowing third parties to track them through browser fingerprinting.
