Equate Benzene Class Action Lawsuit Overview: 

  • Who: Jimmy Ahmed filed a class action lawsuit against Walmart Inc. 
  • Why: Ahmed claims Walmart markets and sells Equate brand body sprays that are contaminated with the chemical benzene, a known human carcinogen.
  • Where: The class action lawsuit was filed in New York federal court.

Walmart markets and sells Equate brand body sprays containing the chemical benzene, a known human carcinogen, a new class action lawsuit alleges.

Plaintiff Jimmy Ahmed claims that, despite listing both the active and inactive ingredients of the Equate body sprays, Walmart fails to disclose that the product contains benzene. 

Ahmed says he would not have purchased the Equate body spray he did had Walmart “not made the false, misleading and deceptive representations and omissions,” 

Further, the Equate body spray Ahmed bought was “worthless,” he argues, due to the fact it contained benzene. 

The benzene contamination came to light following a report by Valisure, an independent analytical pharmacy, which found a number of health care and cosmetic products contained traces of the chemical. 

Benzene can cause a number of health issues, according to the Center for Disease Control, including anemia, immune system damage and blood cancers such as leukemia, according to the class action lawsuit. 

Walmart “Intentionally” Concealed Benzene Contamination, Plaintiff Claims

Ahmed claims Walmart intentionally concealed the benzene contamination because it knew it would lose customers if they knew the truth. 

“Defendant knows that if it had not omitted that the Product contained benzene, then Plaintiff and the Class would not have purchased the Product at all,” the class action lawsuit states. 

Ahmed argues Walmart is guilty of fraudulent concealment and unjust enrichment, among other things, and in violation of New York General Business Law

Plaintiff is demanding a jury trial and requesting relief in the form of monetary, statutory, punitive, and treble damages for himself and all Class Members. 

Ahmed wants to represent a nationwide class and New York subclass of consumers who purchased Equate body sprays containing benzene. 

Multiple class action lawsuits have been lobbied against companies in the wake of the Valisure study, including Procter & Gamble, Unilever and Thriving Brands LLC, among others.

    I would like to be added. After using the equate brand body wash, which was labeled for sensitive skin. I was diagnosed with allergic dermatitis, where my body became infected with large blisters and rashes. I have several scars and scabs that have still not healed. I o ly after stopping the use if the soap, has the blistering and pain stopped.
