Right Guard Benzene Class Action Lawsuit Overview:

Thriving Brands LLC and Henkel Corporation marketed and sold Right Guard brand deodorant body sprays containing the cancer-causing chemical benzene, a new class action lawsuit alleges.
Plaintiff Peter Carbone claims Thriving and Henkel use advertising that is false, deceptive and misleading by not listing that the product contains benzene, which has been linked to certain blood cancers such as leukemia, in its ingredients or on its packaging.
Carbone wants to represent a nationwide class and New York subclass of consumers who bought any of the affected Right Guard brand body sprays anywhere in the country or state, respectively.
Carbone claims he would not have purchased the Right Guard brand body sprays had he known they contained benzene, which he argues makes the products “worthless.”
Companies Intentionally Concealed The Presence Of Benzene From Consumers, Class ACtion Claims
Consumers are, meanwhile, unable to test the products for their ingredients, so they must rely on manufacturers to be honest about what they contain, Carbone argues.
“Consumers lack the meaningful ability to test or independently ascertain or verify whether a product contains unsafe substances, such as benzene, especially at the point of sale,” states the class action lawsuit.
The benzene contamination first came to light following a study by Valisure, an independent analytical pharmacy, which found a number of products, including certain Right Guard brand body sprays, contained varying traces of benzene.
Part of the study found manufacturers could have avoided the benzene contamination, according to the class action lawsuit.
Thriving and Henkel intentionally concealed from consumers that a number of its Right Guard brand body sprays contain benzene, Carbone says, arguing they knew it could keep potential customers from purchasing them.
Carbone claims Thriving and Henkel are guilty of fraudulent concealment and unjust enrichment, among other things, and in violation of New York General Business Law.
Plaintiff is demanding a jury trial and requesting relief in the form of monetary, statutory, treble and punitive damages for himself and all Class Members.
A number of class action lawsuits have been filed against product manufacturers in the shadow of the Valisure study, including against Bayer, Suave and Procter & Gamble, among others.
