P&G, Old Spice, Benzene & Class Action Lawsuit

P&G Old Spice Benzene Class Action Lawsuit Overview: 

  • Who: Matthew Lopez, Erik Velasques, and Frank Ortega filed a class action lawsuit against The Procter & Gamble Company (P&G). 
  • Why: Plaintiffs claim P&G sells Old Spice antiperspirant sprays containing benzene, a known human carcinogen. 
  • Where: The class action lawsuit was filed in Ohio federal court. 

Procter & Gamble (P&G) manufactures, distributes, and sells Old Spice antiperspirant, deodorant, and body sprays containing benzene, a known human carcinogen, a new class action lawsuit alleges. 

Plaintiffs Matthew Lopez, Erik Velasques, and Frank Ortega claim P&G fails to disclose its Old Spice spray products are contaminated with benzene. 

Lopez, Velasques, and Ortega want to represent a nationwide economic loss Class of consumers who purchased a contaminated spray, as well as California and Florida economic loss subclasses. 

Plaintiffs also want to represent a nationwide medical monitoring Class for consumers who purchased a contaminated spray and have been since diagnosed with cancer or another health condition caused by benzene exposure, as well as California and Florida medical monitoring subclasses. 

Lopez, Velasques, and Ortega claim the benzene contamination came to light following a citizen petition submitted on Nov. 3, 2021 by Valisure, an independent analytical pharmacy, which found a number of products, including Old Spice sprays, contained dangerously high levels of benzene. 

Valisure petitioned the Food and Drug Administration to recall the products which were found to be contaminated with benzene, according to the class action lawsuit.

Benzene exposure has been linked to blood cancers such as leukemia, as well as other health problems including soft tissue injury or irritation, say Lopez, Velasques, and Ortega. 

“P&G knew or should have known of the dangerous and carcinogenic effects of benzene and should have known that it was producing products that contained benzene,” states the class action lawsuit. 

Lopez, Velasques, and Ortega claim P&G is guilty of breach of express and implied warranty, fraudulent misrepresentation, fraud by omission, negligent misrepresentation, unjust enrichment, and negligent failure to warn. 

Plaintiffs argue P&G is also in violation of California’s Consumer Legal Remedies Act and False Advertising Law, and Florida’s Deceptive and Unfair Trade Practices Act.

Lopez, Velasques, and Ortega are demanding a jury trial and requesting equitable, injunctive, and declaratory relief, as well as restitution, disgorgement, and all appropriate damages for themselves and all Class Members. 

A similar class action lawsuit was filed earlier this month against Unilever by a consumer who alleges the company sold Suave brand antiperspirant aerosol and spray products containing benzene. 

A separate class action lawsuit was also filed this month against P&G by a consumer in Florida who alleges the company sold certain Old Spice and Secret brand antiperspirant sprays containing benzene
