SunRun Deceptive Marketing Class Action Lawsuit

SunRun Inc.SunRun Inc. has been hit with a class action lawsuit alleging the San-Francisco-based solar energy company deceived consumers into leasing SunRun solar panels by making misleading claims about their cost savings and about the increasing costs of electricity.

Plaintiff Shaw Reed alleges in the SunRun class action lawsuit that the company misled consumers into believing they could save money on “rising electricity costs” by using SunRun solar panels despite the fact that the energy prices at Southern California Edison began dipping or plateauing after 2008.

“The central premise of SunRun’s uniform marketing campaign is that increases in electricity prices will result in cost savings by installing the SunRun Solar system,” Reed says in the SunRun class action lawsuit. “But SunRun deceptively states with certainty something that is inherently unknowable.”

Reed further alleges in the SunRun class action lawsuit that the company was operating without a business license from 2007 to February 2012. The class action lawsuit is seeking a refund on customer fees from contracts entered into before 2012.

The SunRun class action lawsuit also claims company agents misleadingly told consumers they could terminate their SunRun contracts if they move.

The SunRun class action lawsuit is brought on behalf of all persons and entities in the state of California who entered into a solar power contract with SunRun prior to February 2012. It is also seeking to represent a subclass of all Class Members who were told by SunRun that they could terminate their contracts without further obligation if they moved.

The SunRun Class Action Lawsuit case is Shawn Reed v. SunRun Inc., Case No. BC498002, Superior Court of the State of California, County of Los Angeles.


UPDATE 6/29/13: A federal judge has refused to dismiss the SunRun Deceptive Marketing Class Action Lawsuit, allowing it to move forward.

    We also are having issues with Sunrun originally Vivint. We have found out our solar has not been transmitting to our power company, PG&E, since July 25, 2023. We contacted Sunrun because they have been still charging us monthly. They said in the contract, in fine print, it states they have the right to charge us whether our system is charging or not. Who reads the small fine print when they are pressuring you to sign the contract? They are coming out to check why our system is not transmitting to PG&E, but I do not think they are going to take any responsibility. Why don’t they have some sort of alert system to let them know something is wrong? I did not find out until we received our true-up from our utility company. PG&E is the one that told us Sunrun’s power grid was not transmitting to them. We are very frustrated with their customer service who doesn’t seem to want to help at all. We are having to wait a week for them to come out and check on the problem while nothing is being transmitted to our utility company, but we are still being charged by Sunrun. It’s ridiculous to have to wait that long. I guarantee you if I go out and turn the switch off, they will contact us immediately. Also, I agree with the other customer who stated that while we do have the opportunity to buy out our system, it outrageously expensive! Also, in fine print, it states they do not allow transfers of ownership if you sell your house. We have to purchase it! Something needs to be done, this just isn’t right!

    Having issues with the solar production. I was promised 112% production and SCE billed us 2400 for the excessive usage. I need to file a case with them and I’m not paying or unable to pay this bill. Also I took a snapshot of the number of panels installed and per final design it suppose to be 25 panels and it’s only 24.

    Hi my name is Michael ryder I have been dealing with sunrun for well over a year in a half it’s been since 2021 when they installed my first system and it did not even make enough energy for my property after they told me it way big enough for it also was told of time of install the panel on my house needed to be upgraded cause it was not right they ignored it and finished the first system then they came to install a second system and it’s been over a year and a half at this point with it failing over and over due to no panel upgrade on there end and them taking shortcut after short cut so they did not have to do a panel upgrade finally they did the panel up grade after a year and a half and still no system up and running it has caused me so much pain with no response from them unless I called them it’s been almost 2 full years from the start of the project and them taking a lot of shortcuts and huge bills from SDGE because I was told the system would make enough energy to provide for my place please reach out for more information there is way more than this with there customer service and what

    I’ve tried numbers time to get Sunrun to honor their commitment but they say that they will do nothing unless I pay $195 to have them check out why their system isn’t doing what they promised currently it only produces a 3rd of what they promised and we are looking at starting a class action lawsuit just looking for the law office to go through

    I currently have an open case with SunRun. Case#11997448, I have all emails saved.
    Problem is the amount paid to Sunrun and SCE each month.
    I have asked for more panels to be added, Sunrun will not do this.
    SunRun doesn’t have battery backup.
    I have asked if I can pay for adding more panels and adding a third-party battery backup.
    I was denied.

      We are having the same problem they lied and mislead us causing us to pay double the cost for power and Sunrun refuse to do anything to check or fix the problems unless we pay for an extra service

    I feel for y’all as my wife and I were bold face lied to by not only a slick SunRun salesman, but we had none other than the district manager himself. I think he was trying to show the less aggressive door knockers that he could sell us after we sent them on their way a few weeks prior. He waited to approach me while my neighbor was having his ‘free roof’ installed and I was outside doing some yard work.

    This guy told us everything we wanted to hear – free roof (ours will need replacement in a few years), no contracts, no increases (that he had ever seen), credits, no liens and we could switch back to NGRID whenever we wanted. The way that everything was presented including the contract that I signed, without being told it was a contract, was very convincing and on a handheld tablet that I did not have the opportunity or control over to review what I was told that I was signing, which was to authorize them to speak with our utility. It was never presented as a twenty five year lease in any way shape or form. BTW, the monthly price doubles prior to year twenty five at our 3.5% annual increase written in the contract that was never verbally conveyed to either of us.

    I don’t know why, because I hate reading them, but I had a little deadtime and so I started reading the contract that was emailed to me after signing. As I went deeper into my obligations (the pages of the contract) I became horrified at what I signed up for without knowing I had signed up for it. The buyout at anytime prior to year twenty is more than privately owned professionally installed solar panels. If we sell our house before our lease or PPA ends, we either needed to get the new owners to sign on with SunRun and continue the misery or we would be on the hook for buying out the contract, which by the way is the equivalent of? … correct! Twenty five years of payments! We also don’t own the panels after the contract is up they take them back. Not sure if they fix the roof after removal or how it would look.

    I immediately got on the phone while simultaneously feverishly emailing the cancellation address provided in the contract. We had a short window to cancel or we were locked in so I acted as quickly as I could. If I had done what I usually do and chucked the contract in a folder without reading, I would have been crying today and everyday for the next couple of decades. For what it is worth NGRID announced a rate decrease in MA beginning December 1st. This is something we would never ever have seen under SunRun.

    I feel something should be done to support those who have been taken advantage of by SunRun. SunRun should not be able to get away with saying what they say and promise without being held to it. I feel bad for my neighbors that fell prey, but I had no idea they signed up until their roof was being installed. Honestly, I am afraid to bring up the topic.

      Oh no! I don’t even want to hear this. I have the same problem. Vivant/Sun run sent 2 contracractors out I have photos and an estimate. Clearly shows alk the random holes drilled in my roof 9 years ago looking for rafters and not patched. It’s been raining into my attic for 9 years on top of blown insulation. Now my ceiling is water stained and ready to collasp.

    We are with Sunrun & are very unhappy! We signed with Vivint Solar & Sunrun took over. I would like someone to contact us about getting out of our contract.

    Having roof leaks. My homeowners insurance (USAA) came out as well as 3 other inspectors that Sunrun sent out & they all said it was seal failures on my solar panels(not the 1st time either). Thinking it would be as easy as the previous leak fix. The inspectors said Sunrun would be calling me to start the replacement of Half my roof. Crickets for a month. Suddenly I get get a 5th inspector with only 40 minutes warning because he called me, not Sunrun. Went up to the roof for 5 minutes, came down & stated that Sunrun would infact NOT be taking responsibility for the damage. That all the other Sunrun inspectors (he was not a Sunrun employee) were wrong & they would not be fixing the damage. I explained that my homeowners inspector said it was Sunruns responsibility & insulted the military inspectors. WTH?
