SunRun Deceptive Marketing Class Action Lawsuit

SunRun Inc.SunRun Inc. has been hit with a class action lawsuit alleging the San-Francisco-based solar energy company deceived consumers into leasing SunRun solar panels by making misleading claims about their cost savings and about the increasing costs of electricity.

Plaintiff Shaw Reed alleges in the SunRun class action lawsuit that the company misled consumers into believing they could save money on “rising electricity costs” by using SunRun solar panels despite the fact that the energy prices at Southern California Edison began dipping or plateauing after 2008.

“The central premise of SunRun’s uniform marketing campaign is that increases in electricity prices will result in cost savings by installing the SunRun Solar system,” Reed says in the SunRun class action lawsuit. “But SunRun deceptively states with certainty something that is inherently unknowable.”

Reed further alleges in the SunRun class action lawsuit that the company was operating without a business license from 2007 to February 2012. The class action lawsuit is seeking a refund on customer fees from contracts entered into before 2012.

The SunRun class action lawsuit also claims company agents misleadingly told consumers they could terminate their SunRun contracts if they move.

The SunRun class action lawsuit is brought on behalf of all persons and entities in the state of California who entered into a solar power contract with SunRun prior to February 2012. It is also seeking to represent a subclass of all Class Members who were told by SunRun that they could terminate their contracts without further obligation if they moved.

The SunRun Class Action Lawsuit case is Shawn Reed v. SunRun Inc., Case No. BC498002, Superior Court of the State of California, County of Los Angeles.


UPDATE 6/29/13: A federal judge has refused to dismiss the SunRun Deceptive Marketing Class Action Lawsuit, allowing it to move forward.

    I have been dealing with Sunrun/ Vivant since 2014. Saved nothing panels never work never get credit and mow my roof is leaking and they will not respond and the roofer won’t come out until sunrun does.

      I started with Vivent, they put panels on in 2015, in my name, mind you, I am not the owner of the house, have had 26+ incident reports over leaks, now Sunrun bought them and can out and said it’s the roofs fault I’m having leaks, Vivent should’ve put new roof on, and Sunrun should’ve made new contract.

    I was also lied to in regards to the cost savings once I had solar panels installed on my roof. Sunrun told me time and time again what my cost savings would be once I had the panels installed. NEVER once did they tell me i’d produce 40-55 KWH per day with 28 panels. We live in Az and my panels are facing south, sun EVERY day. Never did I think that 28 panels would only produce 40-55 kwh per day. The way the salesman talked we had the BEST OF THE BEST with 28 panels. We’re so disappointed with the whole Sunrun situation i’d just lik them off my roof and be done with solar!

    I being dealing with sunrun regarding the panels that was not producing enough energy for over 3 years and the keep sending over 20+ technicians to work on the systems and they saying that it’s not their job they had to send another technician that knows about the system

I have to contact them over and over and over and I just get the runaround was being misled I’m a senior citizen living on a low income. I don’t think that’s right what they did I keep calling every month. Someone needs to do something. they constantly lie about everything. This is a terrible nightmare. I’m just asking for the assistance to be off.

    Same exact thing as everyone else, Sunrun said I would be net zero with the system they put on the house, it hasn’t been close. I pay the utility company almost as much as Sunrun near doubling my power bill in total. Absolute scam.

    We received our solar panels on the roof February 2023 after eight months of waiting for the system to be turned on because initially they put the solar panels on wrong and had to remove them and put them back up because it didn’t pass inspection and last month. We had a really bad storm out here in Southern California due to the hurricane on the coast and my roof started leaking in three of the bedrooms, my laundry room, and my foyer, a lot of damage was done and Sunrun sent out the contracting company that put up the solar panels and it was determined that they did not patch up any of the holes that they put in my roof from the first installation of the solar panels and we’re liable to fix my roof and fix all of the damage on the inside of the house and during that time, I was informed that my solar system had not been working properly since it was turned on back in February, and was not producing the proper amount of energy that it was supposed to. I also was told if I sold my house that I would no longer be under contract. If the new owners did not want the solar panels, they would remove them at no charge and now I’m finding out that none of this is true . I was told by one of the Sunrun representatives. that my account would be credited for my system not working properly I have yet to see that mind you I have 49 panels on my roof at the end of the day. It took eight months to get the system up and running properly but it was never actually running properly. I’ve had extensive amounts of damage done to my exterior roof and my interior ceiling and my attic and the system has not produced the amount of energy that I was promised. It’s just a mess and I really don’t know what to do.

    Sunrun sold me a scam. The system is not capable of handling my energy demands and Sunrun knew they sold me a system that would not work. Been going back and forth with Sunrun for 2 years and the escalation team only came back to inform me i needed a second system. Sunrun built me a solar system that can only generate 15,023.00 kWh a year. Now claims i need a system that can generate over 28,000kwh. Sunrun claims my usage increased. and then admitted that they did not build me a big enough system. I am getting electric bills of over $300. I want this worthless panels removed from my roof and loan paid off. I am better off without the solar system. Sunrun claims not to have any wrong doing.

    I was promised saving, I was promised 125% of solar production but only set up to produce 75% , they never show me the yearly increase rates and said they were very small, I’m now paying double what i was paying before solar with yearly true- up bills of $3k.

    I am also having the same issues as every one else. My panels were not producing for months. When I was fondly able to contact them , witch was very hard they said yes it was not producing and that I would not be refunded

    I too was told I didn’t need a new roof and that I would see savings but none if thsg is true and now homeowners is canceling my policy be because I need a new roof and that something I cannot afford.
