SunRun Deceptive Marketing Class Action Lawsuit

SunRun Inc.SunRun Inc. has been hit with a class action lawsuit alleging the San-Francisco-based solar energy company deceived consumers into leasing SunRun solar panels by making misleading claims about their cost savings and about the increasing costs of electricity.

Plaintiff Shaw Reed alleges in the SunRun class action lawsuit that the company misled consumers into believing they could save money on “rising electricity costs” by using SunRun solar panels despite the fact that the energy prices at Southern California Edison began dipping or plateauing after 2008.

“The central premise of SunRun’s uniform marketing campaign is that increases in electricity prices will result in cost savings by installing the SunRun Solar system,” Reed says in the SunRun class action lawsuit. “But SunRun deceptively states with certainty something that is inherently unknowable.”

Reed further alleges in the SunRun class action lawsuit that the company was operating without a business license from 2007 to February 2012. The class action lawsuit is seeking a refund on customer fees from contracts entered into before 2012.

The SunRun class action lawsuit also claims company agents misleadingly told consumers they could terminate their SunRun contracts if they move.

The SunRun class action lawsuit is brought on behalf of all persons and entities in the state of California who entered into a solar power contract with SunRun prior to February 2012. It is also seeking to represent a subclass of all Class Members who were told by SunRun that they could terminate their contracts without further obligation if they moved.

The SunRun Class Action Lawsuit case is Shawn Reed v. SunRun Inc., Case No. BC498002, Superior Court of the State of California, County of Los Angeles.


UPDATE 6/29/13: A federal judge has refused to dismiss the SunRun Deceptive Marketing Class Action Lawsuit, allowing it to move forward.

    Sunrun previously Vivant, Trying to get me for 51,000 thru collection agency, and I’m in the hole with so cal Edison 3,000 dollars.

    I’d been approached by Sunrun Representatives a number of times about having panels installed at my home. My response was the same: I’m a senior citizen who lives alone, uses very little electricity, and have no need for solar panels. On occasion at Home Depot, a representative stopped me to explain Sunrun’s new offers of a service where customers would not have to buy or lease the panels. The company would install the equipment at zero cost to me, and I would simply purchase services from Sunrun as I currently do from my utility company; it would be like switching from one utility company to another. If I sold my home, the new owner would have the option to continue services with Sunrun. Sunrun would be responsible for the care of the panels at all times. All I would need to do is occasionally rinse them off with the garden hose. At no time was I told I was taking a 25-year contract. I was told I was in a contract when I contacted them regarding having the panels removed because of underperformance and poorly installed critter guard.

    I am going thru similar issues with Sunrun The lies are true. After waiting 4 months for them to finally turn them on. We had to get a new roof a few years after install and that was discussed with the salesman. He said it would be $500, to remove and put panels back on after the new roof, when the time came the price was $5,000 !!! Who would pay that?? I told them I had notes that I took from salesman which I had to send to Sunrun as proof. Now they are harassing me daily to pay the $500 in full!! I’ve paid $200 so far but the 2nd $100 was put towards the energy bill NOT the field service!! Pretty sneaky🤬 I’m not surprised at their underhanded move! I’m going to call them and have them put the money for the “field service” not the electricity. I’ll be letting the world know what next step.

    I’m looking for an attorney that can help me with my problem.
    I was told that my system they installed in my home it was going to cover a 100%
    Also got a battery for outages and I out of 18 klw I bought I get only 6klw.
    And I just had an outage and the battery didn’t work.
    Technician came by told me the problem and left.
    And now I see my records and they have closed my case

      SunRun COMPLAINT
      We’ve given Sunrun 5 years and have contacted them on several occasions because they are simply underperforming.
      We pay $162. per month and the rate goes up every year by 2% for so-called inflation, even though the panels are expected to perform at a diminished rate with time. We still pay anywhere from $200.00 – $300.00 per month to Duke.
      With that said, they are CRAP. We do have trees but they took those trees into consideration when we installed them and were told we’d have a small Duke bill despite it.

      They did take 2 panels off so that it could pass inspection & we’ve contacted them about a damaged panel. To date, we are just told that they are working 95%.

      We’re thinking of locating an attorney to handle this because their representative misrepresented the company at signing & if we were at the very least, getting proper use out of them, we would disregard the misrepresentation but enough is enough.

      At this time, we want to remove the panels since they are nothing but useless garbage. DO NOT HIRE SUNRUN. Their customer service is also horrible.

    I too am most unhappy with Sunrun! Not only was I lied to but the door to door sales person took advantage of my husband, who had Demetria, to get to me. I could go on and on …. Right now they are harassing me (for over a month), for 4 cents, they are saying I owe them! (Never in my life have I been late or missed a payments to ANYONE I owe!) MOST DISAPPOINTED .. I too would love to get out of the contract with them but I do not know where to begin or have the energy.

    Everything about this company is wrong. I was completely deceived by the representative for Sunrun. Didn’t even receive a contract until months later after I requested it. I was told I could remove them at anytime free of charge which I found out a year later when I needed a new roof not true. I am 63 on oxygen and fixed income. My system went down in the beginning July and wasn’t fixed until today October 09. I was told they were waiting for a part. I live in Las Vegas temperatures in the 100’s. Energy bills a few hundred dollars a month along with $152 Sunsun bill. Customer service isn’t helpful at all.

    I’m having problems with Sunrun and who they work with Bright Planet Solar. It’s costing me more money. After they installed the panel they didn’t even turn them on. My tune up was 1400.00 dollars with PG&E. I want them gone. By the company Mosaic keeps charging me more. I’m so over it.
