Samsung Refrigerator Class Action Lawsuit Overview:

  • Who: Two customers filed a class action lawsuit against Samsung. 
  • Why: Certain Samsung refrigerators with French doors allegedly contain a defect that causes temperatures to rise inside, keeping food at an unsafe temperature.
  • Where: The class action lawsuit was filed in New Jersey federal court.

Two Samsung customers are suing the South Korean electronics giant and its American offshoot for allegedly defective refrigerators that “pose unreasonable risks of property damage and serious personal injury during normal use” by running above temperatures for safe food storage. 

The refrigerators in question have varying model numbers, but all are made with French doors and a bottom freezer.

The plaintiffs are Matthew Jordan and Lisa Saghy, both of whom bought new Samsung refrigerators. In both plaintiffs’ experiences, repairs by a Samsung technician failed to remedy the temperature issue. Now, they claim Samsung refuses to provide more repairs, replacement or refund. 

Jordan and Saghy seek to represent a nationwide class, a California subclass, and a Pennsylvania subclass to include all residents who bought a new Samsung refrigerator or otherwise acquired one, primarily for household use and not for resale.

Samsung Tech Allegedly Admits Refrigerator Defect ‘Cannot Be Fixed’

Jordan bought his new Samsung refrigerator for $1,298 in 2020. After a few months, he began to notice food in the bottom of the refrigerator was frozen while the top of the refrigerator held a “temperature that was too high to be safe for food storage,” according to the complaint.

Saghy bought her new Samsung refrigerator in 2017 for $2,256. In January 2022, she began to notice the refrigerator was not keeping food and drinks as cold as before and ice was forming on the back panel. In March, a technician told Saghy the temperature issue was “a known defect” and “cannot be fixed,” according to the complaint.

The Samsung class action lawsuit alleges the company knew about the temperature defect but concealed it from consumers while continuing to sell the product.

Between January 2019 and December 2021, the Consumer Product Safety Commission (CPSC) received over 600 complaints about Samsung refrigerators, according to court documents. At least 211 complaints cited food spoilage; 62 cited food poisoning, according to Consumer Reports.

    I bought a Samsung refrigerator in January of 2017. Model# RF18HFENBWW. It has constantly faied to provide a proper temperature in the refrigerator area. The lower freezing area seems to be ok. Recently (last week) I had an appliance repair person at my home to repair the problem. I have receipt showing I paid him $680.74 . He made me aware that the problem could possibly reoccur because of issue’s Samsung has had with my type of refrigerator. In the past I could unplug it and let it thaw out after two days, then plug it back in and it would work properly for a few months. Fortunately I have an extra refrigerator in my garage that allows me to do this. In fact, it is the old refrigerator that was replaced by our Samsung when we bought our home. This has truly caused my wife and I a lot of worry and extra work in the past, and my confidence in the recent repair is not high after being told by the repairman that this has been an ongoing problem with these refrigerators.

    My samsung refrigerator stopped working. The filter is freezing. Its only a year and half old. They can’t find a service tech in my area to fix it.

    i have one that the ice mKer has been replaced 2 times, leaks water and doesnt keep temp. also

    my ice maker doesn’t work & the back panel of my samsung refrig freezes up and has to be thawed out every three weeks! Lowe’s has sent a repairman 6 times. the frig is still not working!!

    I have a Samsung refrigerator and the fan goes out and then stops cooling. This has happened four times in the last year and a half. I have Choice Warranty and they refuse to pay for a new refrigerator. Instead, they want to continue to “fix” it, costing me $65 each time, plus two days each time of waiting for them to come out diagnose it, and then the second day of parts and repair. It has cost me food, time and money.

    Nothing but problems with my Samsung! has been a problem from about 6 months after I got it with both the Ice Maker and the temp and after most of my food had to be tossed due to temp we had to get a new one. This happened all in about 4 years time where we had it fixed two times and got left hanging by Samsung and repair would no longer even come out! They make trash and don’t support the products they sell! I would never buy from them again as they are getting people sick and no repairing or replacing the junk they sell!

    I have a French four door Samsung that won’t cool anymore I would like to file a suit against them.
    Just a garbage refrigerator had to replace easy breakable drawers and shelves as well.

    We bought a Samsung French Door with freezer on the bottom in 2/2021. Recently we noticed our milk kept spoiling several days before the expiration date. We thought it may have been the milk producer so we changed brands, it continued. Also our lunch meat, lettuce, other fruits and veggies were spoiling quickly. We turned the temp down as far as possible but the food was still spoiling. We ordered a couple old fashioned refrigerators thermometers, we put 1 in the bottom of it and the top shelf. It averages 45-50 degrees all day every day. I contacted Samsung, the issued a repair ticket and send us the info of their service contractor. The service contractor refused to even look at the unit because it was over a year old. I hired a repair service, he came and took it apart, checking the whole thing out, he said everything was working but not only was it the fridge running warm so was the freezer. He said it was a sealed system issue which is covered by Samsungs warranty parts and labor for 5 yrs from purchase. He couldn’t touch the sealed system or it would’ve voided my warranty. I called Samsung again, told them the issue, first he refused to do anything but I sent him the text messages from his contractor refusing service and the diagnosis from my contractor that I paid $95 for. He asked me to text him the invoice & diagnosis which I did while we were talking, he agreed to pay for the service call, the repairs of the sealed system issue and my spoiled food. I noticed I got another Samsung service ticket sent to Cone appliance, the same contractor that refused to look at it again. The next day I called Cone to explain it is under warranty, the Sealed System has 5 yrs parts and labor. She refused again, said they do nothing with any unit over a year old and transferred me to Samsung. I had to start over again with Samsung, they tried to call Cone Appliance to verify they refused but Cone quit answering the phone. I was then told they were emailing Cone and they could look for another contractor to fix it after Cone replied to the email. I said “What if Cone doesn’t answer you, then what?” She had no answer to that, Aura, was the name of the female I was speaking to this time. Now there is nothing they can do because the contractor isn’t answering them. I don’t know where to go from here. My repair company won’t touch it because he said Samsung is junk and he’ll be getting service calls for the next 5 yrs for it. What can I do now?

    My year warranty was up July 3, 2023. I reported that the fridge will not work, it trips every socket put into, even with a serge protector. They sent their company out and they fixed a ice maker, which would be great if it turned on. I complained and asked for a refund. I jumped through hoops through Lowes to get a clear copy because they said they could not read mine from a year ago. Now they say they can not confirm when they call the store, although I had manager Josh on the phone when I got my 2nd receipt from Lowes. Now it has been 2 months- no fridge and still waiting for review department to contact me. I call everyday but same old excuses every time. I’m single mom with 2 boys in college and even though I work at hospital, I have no extra money . I will keep trying, so if anybody has advice please I’m open to suggestions.
