Samsung Refrigerator Class Action Lawsuit Overview:

  • Who: Two customers filed a class action lawsuit against Samsung.
  • Why: Certain Samsung refrigerators with French doors allegedly contain a defect that causes temperatures to rise inside, keeping food at an unsafe temperature.
  • Where: The class action lawsuit was filed in New Jersey federal court.

Two Samsung customers are suing the South Korean electronics giant and its American offshoot for allegedly defective refrigerators that “pose unreasonable risks of property damage and serious personal injury during normal use” by running above temperatures for safe food storage.

The refrigerators in question have varying model numbers, but all are made with French doors and a bottom freezer.

The plaintiffs are Matthew Jordan and Lisa Saghy, both of whom bought new Samsung refrigerators. In both plaintiffs’ experiences, repairs by a Samsung technician failed to remedy the temperature issue. Now, they claim Samsung refuses to provide more repairs, replacement or refund.

Jordan and Saghy seek to represent a nationwide class, a California subclass, and a Pennsylvania subclass to include all residents who bought a new Samsung refrigerator or otherwise acquired one, primarily for household use and not for resale.

Samsung Tech Allegedly Admits Refrigerator Defect ‘Cannot Be Fixed’

Jordan bought his new Samsung refrigerator for $1,298 in 2020. After a few months, he began to notice food in the bottom of the refrigerator was frozen while the top of the refrigerator held a “temperature that was too high to be safe for food storage,” according to the complaint.

Saghy bought her new Samsung refrigerator in 2017 for $2,256. In January 2022, she began to notice the refrigerator was not keeping food and drinks as cold as before and ice was forming on the back panel. In March, a technician told Saghy the temperature issue was “a known defect” and “cannot be fixed,” according to the complaint.

The Samsung class action lawsuit alleges the company knew about the temperature defect but concealed it from consumers while continuing to sell the product.

Between January 2019 and December 2021, the Consumer Product Safety Commission (CPSC) received over 600 complaints about Samsung refrigerators, according to court documents. At least 211 complaints cited food spoilage; 62 cited food poisoning, according to Consumer Reports.

The plaintiffs are represented by James E. Cecchi, Lindsey H. Taylor, and Donald A. Ecklund of Carella, Byrne, Cecchi, Olstein, Brody & Agnello PC and Jonathan D. Selbin and Jason L. Lichtman of Lieff Cabraser Heimann & Bernstein LLP.

The Samsung Refrigerator Class Action Lawsuit is Jordan, et al. v. Samsung Electronics America Inc., et al., Case No. 2:22-cv-02828, in the US District Court for the District of New Jersey.

I also bought a Samsung french door/freezer on bottom refrigerator in 2019. In the last 4 months I have had the repair man out twice due to unsafe warm temperatures in the fridge portion. Temps up to 62 when first noticed. I didn’t even start using the refrigerator until 2020 since I was in the process of building a new home.

  2. Beth says:

I bought a Samsung side by side refrigerator 3 years ago and had the same issue. The fridge only lasted 3 years before it completely quit and the repair tech said that it was a known issue and it cost more to fix than the fridge was worth.

  3. Alicia Maloney says:

The back panel of my samsung fridge builds ice so fast that I have to completely remove everything, remove the backplate, and use a hair dryer to get rid of all the ice every month. Without fail. I have lost so much money in spoiled food it isn’t even funny. I’m amazed I haven’t gotten sick from food poisoning yet.

  4. Michelle DiCarmine says:

I also bought a Samsung and it won’t cool – the tech said it can’t be fixed – I am still getting the run around since August 2023. It was insured and under warranty – they just keep telling me they will make me an offer – it’s December

  5. Ray Bailey says:

We have a Samsung refrigerator that we have had problems with pretty much since we bought it. The ice maker sucks and it randomly has an extremely loud fan and now the ice maker is leaking. It creates mold on the inside because of how it continuously leaks. We would like to join the class action lawsuit. We would seriously like to have a fridge that works and stop having to call to have it fixed. I can not find a link to join the lawsuit. Can someone please send it to me. I am so frustrated!

  6. Gilbert A. Chediak says:

I purchased a Samsung French Door refrigerator in 2019, Last September it stopped cooling,
Samsung came in the following week and replaced the compressor, it never cooled. A week later they
they sent another tech who said it needed another compressor and a dryer. The fourth visit from still another
technician finally concluded that the fridge was unfixable. Samsung sent me a text that they were willing
to send me a prorated share of the original price,
a week later I have not been contacted and have been unable to contact them by text or email.
Samsung is not a serious Company that mistreats their customers with defective products and lousy
cuatomer service. Wish I knew this before I bought their bile products.

  7. Linda Gray says:

I bought a Samsung French door refridgeator manufactured in Jan of 2021, and have had it repaired 4 times (spending more in repairs than it cost new), It doesn’t keep food cold on the top, and doesn’t make ice. Samsung refuses to fix this and I have to keep paying for repairs, I’m going to have to buy a new refridgeator now. I’m soo tired of this

  8. EWA CHMURA says:

I ALSO BOUGHT A SAMSUNG FRIDGE, EVERY 4 MONTHS I HAD TO DEFROST THE FRIDGE BECAUSE THE BACK PANEL FROZE UP AND THE FAN WOULD STOP WORKING, LOT OF SPOILED FOOD, AFTER DEFROSTING IT SO MANY TIMES I BOUGHT A NEW FRIDGE.

  10. Cassandra Michaelsen says:

I had bought my refrigerator in 2019 for $1639 and a year later I started having issues with my ice maker which I had to fight to get replaced. I also have issues with my refrigerator and middle drawer not keeping food at a cool enough temperature, along with ice buildup on the back panel of the fridge. I have made several calls to Samsung about this and they continue to tell me that this is not a known complaint nor is it covered under warranty after 1 year, even though when looking up my warranty, it states that this issue should be covered.
