Samsung Refrigerator Class Action Lawsuit Overview:

  • Who: Two customers filed a class action lawsuit against Samsung.
  • Why: Certain Samsung refrigerators with French doors allegedly contain a defect that causes temperatures to rise inside, keeping food at an unsafe temperature.
  • Where: The class action lawsuit was filed in New Jersey federal court.

Two Samsung customers are suing the South Korean electronics giant and its American offshoot for allegedly defective refrigerators that “pose unreasonable risks of property damage and serious personal injury during normal use” by running above temperatures for safe food storage.

The refrigerators in question have varying model numbers, but all are made with French doors and a bottom freezer.

The plaintiffs are Matthew Jordan and Lisa Saghy, both of whom bought new Samsung refrigerators. In both plaintiffs’ experiences, repairs by a Samsung technician failed to remedy the temperature issue. Now, they claim Samsung refuses to provide more repairs, replacement or refund.

Jordan and Saghy seek to represent a nationwide class, a California subclass, and a Pennsylvania subclass to include all residents who bought a new Samsung refrigerator or otherwise acquired one, primarily for household use and not for resale.

Samsung Tech Allegedly Admits Refrigerator Defect ‘Cannot Be Fixed’

Jordan bought his new Samsung refrigerator for $1,298 in 2020. After a few months, he began to notice food in the bottom of the refrigerator was frozen while the top of the refrigerator held a “temperature that was too high to be safe for food storage,” according to the complaint.

Saghy bought her new Samsung refrigerator in 2017 for $2,256. In January 2022, she began to notice the refrigerator was not keeping food and drinks as cold as before and ice was forming on the back panel. In March, a technician told Saghy the temperature issue was “a known defect” and “cannot be fixed,” according to the complaint.

The Samsung class action lawsuit alleges the company knew about the temperature defect but concealed it from consumers while continuing to sell the product.

Between January 2019 and December 2021, the Consumer Product Safety Commission (CPSC) received over 600 complaints about Samsung refrigerators, according to court documents. At least 211 complaints cited food spoilage; 62 cited food poisoning, according to Consumer Reports.

The plaintiffs are represented by James E. Cecchi, Lindsey H. Taylor, and Donald A. Ecklund of Carella, Byrne, Cecchi, Olstein, Brody & Agnello PC and Jonathan D. Selbin and Jason L. Lichtman of Lieff Cabraser Heimann & Bernstein LLP.

The Samsung Refrigerator Class Action Lawsuit is Jordan, et al. v. Samsung Electronics America Inc., et al., Case No. 2:22-cv-02828, in the US District Court for the District of New Jersey.

Had to replace a whole motor at a cost of 500.00 on front load dryer just after one year. Ice maker just replaced today in our 4 door flex. they found something else they said it wouldn’t be covered under warranty also. Something to do with temperature. Worst appliances ever. Wait for a star whole house with nothing but Samsung. We keep holding on for us to see which one is going out next.

    Worst Frig EVER!!
We have had food poisoning food spoilage Petit off leaking water when she gets the refrigerator all gunky and disgusting. The icemaker doesn’t work we had repairman out three or four times at the beginning they said “they fixed it”. — they did not. We use our old refrigerator out in the garage for important things that still lose a lot of food to the stupid refrigerator. How can I get it on the class action lawsuit??!?!!

Same issues as everyone. We’ve had a dozen service calls on our refrigerator since we bought it. It goes not keep the temp safe and my wife’s insulin is wet all the time along with spoiled milk and food that has mold on it all the time. The ice unit leaks constantly and clogs up and has never worked properly. I contacted Samsung CEO email and received no help at all.

  3. Shahin Shokoohi says:

I have problems with my Samsung refrigerator since 2016. Problem is temperature and lots of leaking. Model number is RF23J9011SR/AA
    And serial number is 07GG43BH300030T

When I brought my Samsung bespoke in July of 2022, 1 week into buying the fridge, the freezer wasn’t making ice. Called two time the first technician came and reset the freezer and left. In the winter time the freezer makes ice like I’m making an igloo but in the summer time it makes 12 ice cubes every 24 hrs. Now fast forward to July 8th I go grocery shopping put the food in the freezer and the food isn’t freezing. I set the freezer to negative 2 and it froze a little bit. When I came home earlier this morning my food was defrosting, so I put the freezer on negative 4 degrees to see if the food will freeze. The food did not freeze but it continued to defrost. So I had to move the food to the deep freezer. The auto fill water pitcher no longer fills like it’s suppose too. The freezer is cool but not freezing or making ice. I have a tech coming July 19 to possibly fix this situation I am hoping. I’m so over this refrigerator and it’s only been a year. Worst company for a refrigerator.

  5. Steve Viotti says:

Freezer no longer goes lower than 54 degrees. Spoke for hours with Samsung support. Can no longer use freezer. They were to put in a ticket for technician, but has not happened yet. 4 french door refrigerator and computer screen. Purchased in 2018. Manufactured in 2018.
Ice maker freezes up every 3 to 4 weeks and take 1/2 hour to manually defrost. Extremely frustrating $4,000 purchase.

I’m a year in and my freezer is cool but isn’t making ice or freezing my food. Hopefully when they come out Wednesday they can fix it for me.

  6. Christina M Osborn says:

bought samsung side by side counter depth in 2018, ice maker leaked within first year causing ice build up so shut off. now into 5th year not cooling food causing spoilage and food poisoning.

  7. Nancy Richardson says:

Bought Samsung refrigerator in 2015. Now having same problem as many others (not cooling, ice buildup on back panel, water leaking inside fridge). Will attempt to fix with repair kit ordered today. Ice maker hasn’t worked for years – we use trays to make ice.

  8. Alvah Morgan says:

Refrigurator compartment does not cool allowing tempurature to rise causing food apoilage. Evaporator coils freeze over, once defrosted frig cools down for short period of time then gets warm.inside all over again.

  9. Monte Howard says:

This is the 2nd time my Samsung refrigerator (chef collection) has stopped working. Bought it in June 2020 from Best Buy. In 2021, the refrigerator stopped working and flooded my basement from the kitchen. Samsung after many months paid me for the restoration clean up. They fixed the fridge It worked until 2 weeks ago. I have been trying to get it fixed, but no one wants to fix it. Samsung gave me 3 companies, but no one wants to touch it. 2 diagnostics state it was the compressor. I was told today by a technician that was referred by Samsung that it would cost more to fix it then to buy another refrigerator. I understand. This is a french door with middle drawer and bottom freezer. I see where Samsung has class action suits, but it doesn’t include my model. FRUSTRATED. Lost all the food and dairy products.

    1. Ms monte howard says:

Adding additional information to my complaint. Samsung is not being cooperative in my request to pay me fir my fridge, so I can buy another brand. Gaving had one tech who was recommended by Samsung, Samsung says their remarks are not good enough ti pay iut the monies I paid for the refrigerator. Another ticket was made tidsy Aug 21 to have another company take a look at the refrigerstor wuth possible repair. Never buy anither Samsung product. Biw I have to wait anither dsy to see whst Samsung is going to do tomorrow. 2 months later. How do I join a class action law suit?

  10. WHITNEY COX says:

    Manufactured December 2018
    Purchased shortly after.
Had ice maker freeze water leak into bottom of refrigerator. Freezer works fine.
Upper part of refrigerator is not maintaining temp. It is at 61 degrees currently. Has been doing this for 2 weeks. Contacted Samsung and they refuse to help and said that repairs are chargeable since my warranty expired in February 2020
