Hyundai Sonata class action overview: 

  • Who: A couple who bought a Hyundai Sonata sued Hyundai.

Hyundai “abandoned” its customers who bought now-discontinued Sonata Plug-in Hybrid cars, leaving some customers without replacement batteries for over a year, a new class action lawsuit alleges.

Plaintiffs Samuel Kline and Lauren Kline filed the class action lawsuit against Hyundai Motor America Incorporated Jan. 30 in a Maryland federal court, alleging violations of state and federal consumer laws. 

According to the lawsuit, Hyundai sold the Sonata Plug-in Hybrid car in model years 2016 through 2019. It discontinued the Sonata Plug-in Hybrid beginning in the 2020 model year, the plaintiffs say.

The Klines say they bought a new 2017 Hyundai Sonata Plug-in Hybrid car in December 2016. 

The Klines’ car battery failed in December 2021, they say. They brought the car to their local Hyundai dealership, Fitzgerald Hyundai, for service under Hyundai’s promise in its warranty terms to honor a “lifetime” warranty for the battery. 

However, the dealership has possessed the car since then — for more than 13 months — while promising but failing to acquire or install a replacement battery, according to the Hyundai Sonata class action.

Hyundai offers a “lifetime” warranty for the battery that powers the Sonata when operating in electric vehicle mode, the lawsuit says. 

However, the Klines say they believe Hyundai does not honor the warranty because it does not have the ability or available inventory to do so.

“With the discontinuation of that product, Hyundai Motor Co. and HMA have also essentially abandoned all those customers who purchased Plaintiffs and to the class members as the class is defined herein,” the Hyundai Sonata class action alleges.

The plaintiffs seek to represent anyone who purchased or leased new 2016-2019 Hyundai Sonata Plug-in Hybrid Sonata cars from Hyundai authorized dealers in California, Connecticut, Maine, Maryland, Massachusetts, New Jersey, New York and Oregon.

They sued for breach of contract, breach of warranty, fraud and breach of consumer laws. The plaintiffs also want the court to force Hyundai to either provide them with replacement batteries or to compensate them for their losses due to the delay in replacing the batteries.

Last year, Hyundai issued a recall for more than 215,000 of its model year 2013-14 Sonata vehicles due to concerns with the vehicles’ fuel systems.

    Yes I have 2013 Hyundai Sonata and we bought it in 2015 only had 22000 miles the second day we had it we had to have brakes put on the front for brakes where gone rotor worp we e our car only has 77,5089 miles on it we have ended up replacing brake pads and rotor 3 more times since then ,engine quit running almost had tracker trailer almost hitting me in rear end plus steering wheel has a catches and clicks ball joint with only 40,000 and tie rod they replaced driver side but not passenger side and if one side is bad then shortly the other side will fail also which it has transmission slips at times shift stuff or making a winding sound to me we where sold a lemon yes they have fix most the problem but we still are having brake steering wheel now front end ball joints tie rods and I’m want in the lawsuit please

    Add me too! Yup, I too bought a clean 2016 Sonata PHEV at CarMax with around 20k miles and the battery died with screen alerts at around 75k miles… I brought it to a dealer here in LA and thankfully they gave me a free rental… BUT that was over 7 months ago! What a joke! Plus, the rental car, a Toyota Camry, while decent is not as nice a car has cost us easily over $1,200 more in the past 7 months than usual (we drove EV mode most days).. and now Hyundai corp said they would not pay the difference. Totally unacceptable.,

    We leased a 2017 Hyundai Sonata Plug-In and loved it so much, we bought the car after the lease term expired. Unfortunately, the battery has now failed in October 2022. Originally, they told us it could take until January 2023, we’re passed that. We’ve now been without a car for 5 months and the dealer that has our car cannot advise how long this could take, they have no information. Please add us to the Class Action Lawsuit.

    Please add me. I bought a used 2016 Sonata Hyundai Plug in Hybrid Limited from Carmax. I also bought the extended warranty as well. Only 16K miles at the time. Under 50,000 when the battery went out. I would hope that any settlement would not only include what we paid for (Lemon Law) but any other damages for the lack of use of “that” car and false advertisement. Additionally, The Magnuson-Moss Warranty Act, which went into effect in 1975, requires manufacturers to maintain parts for the term of the manufacturer’s warranty. They know that and did not seek to find another manufacturer of that battery.
