Honda transportation charges class action lawsuit overview:
- Who: David Harmon, Ivan Kosin, Matthew Kosin and Shirley Dunn filed a class action lawsuit against American Honda Motor Co. Inc.
- Why: Honda is accused of not revealing the actual charge incurred for transporting its vehicles to its franchised dealers.
- Where: The class action lawsuit was filed in New Jersey federal court.
American Honda Motor Co. uniformly employs a policy that fails to reveal the actual charge incurred for transporting vehicles to their franchised dealers, a new class action lawsuit alleges.
Plaintiffs David Harmon, Ivan Kosin, Matthew Kosin and Shirley Dunn claim Honda violate the Monroney Act by allegedly failing to give consumers in New Jersey the “basic minimum protection” afforded by it.
The Monroney Act requires an automobile manufacturer to “disclose the true cost of transporting vehicles from the final point of manufacture to the point of sale,” according to the Honda class action.
“As established almost 65 ago, the Monroney Act demands forthright disclosure, honesty and good faith in the automobile marketplace,” the Honda class action states.
Honda class action claims automaker uses transportation costs to inflate vehicle price
Harmon, Ivan Kosin, Matthew Kosin and Dunn further claim that Honda’s alleged failure to abide by the Monroney Act “is used as a contrivance for Defendants to arbitrarily inflate the purchase price of its vehicles.”
“Such conduct clearly constitutes an unconscionable commercial practice that has a capacity to mislead New Jersey consumers and evinces a lack of fair dealing,” the Honda class action states.
Harmon, Ivan Kosin, Matthew Kosin and Dunn want to represent a New Jersey class of consumers who purchased or leased a Honda vehicle from a Honda franchised dealership since October 2016.
Honda, in addition to allegedly violating the Monroney Act, is accused of unjust enrichment and disgorgement and of violating the New Jersey Consumer Fraud Act.
The plaintiffs demand a jury trial and request declaratory and injunctive relief along with an award of treble damages for themselves and all class members.
A consumer filed a separate class action lawsuit against Honda in July, claiming the company sold certain vehicles with allegedly defective speakers.
