  • Three classes of General Motors (GM) vehicle owners asked a California judge to throw out GM’s request to overturn a $100 million jury verdict.
  • The classes’ filing told Judge Edward Chen of U.S. District Court in the Northern District of California that it believes expert testimony is not needed for a class action case to succeed.
  • It also states that recent rulings throwing out defect claims in BMW and Mazda vehicles are not the same and do not apply.
  • The filing claims GM’s own witnesses testified the engine defect would occur, leading to the vehicles’ engines consuming an excessive amount of oil.
  • GM attempted to block the verdict, which would have awarded $2,700 each to class members who owned certain versions of GMC Sierra, Yukon and Yukon XL and Chevrolet Avalanche, Silverado, Suburban and Tahoe.

General Motors (GM) has been ordered to pay more than $100 million to classes of vehicle owners who argue the company sold vehicles with defective engines. 

A federal jury in California delivered the verdict against GM after less than one day of deliberation. It will benefit three classes of around 38,000 GM vehicle owners from California, North Carolina and Idaho, Law360 reports. 

Vehicle owners, who will receive $2,700 each, had accused GM of selling vehicles — including certain of its GMC Sierra, Yukon, Yukon XL and Chevrolet Avalanche, Silverado, Suburban and Tahoe — with a hidden engine defect that caused them to consume an excessive amount of oil. 

Jurors determined that GM breached its implied warranty and implied warranty of merchantability with the vehicle owners and violated Idaho’s consumer protection act, Law360 reports. 

Vehicle owners claim GM engine defect hidden from the public 

The vehicle owners claimed GM hid a defect in engines the company introduced in 2007 while the automaker reportedly argued that it discovered and fixed the problem. 

The vehicles at the center of the GM engine defect class action lawsuit include trucks and SUVS sold by the company between 2011 and 2014 that contained a Generation IV Vortec 5300 LC9 engine, Law360 reports. 

An engineer for GM reportedly testified during the trial that the automaker developed a cleaning process as a potential remedy to the defect that turned out to not be effective but was less expensive than a different potential fix. 

A separate class action lawsuit filed against GM escaped dismissal last month after a federal judge in Georgia mostly denied the automakers motion to dismiss claims it made defective engines.

    2018 Chevy suburban with lifter issues causing all lifters and camshaft to be replaced,Cylider deactivation solenoid/manifold among other things to replaced with 77300 miles. This has been a know issue with the 5.3 liter engine created by Chevy knowingly using defective parts. I have contacted Chevy who refuse to pay for repairs. They already lost a class action lawsuit in California Is there a class action in Washington. Chevy should be held accountable for knowingly defrauding consumers.

    2023 GMC Sierra 6.2L V8. Bad engine, almost got me in accident. Likes to shut down when driving 70+mph. Has less than 10,000 miles.

    My 2015 turned over at 100K miles and now the engine has a blown head gasket among other this like 2 years without air bag, navigation screens cracked, light cover fell off and more. At $918 a month I’m walking or taking a taxi or uber. They wrote it off and destroyed my credit and at 70 years old now I cannot get another car. My son was dying in another state and I could not drive there to get him. I had to wait until I save enough money to fly and rent cars to come back. GM has destroyed my life and my son is dead now thanks to them. Google GM lawsuits, there are hundreds, maybe thousands.

    We bought a 2015 Chevy Silverado 3 years ago. It only had approximately 80,000 miles on it when we bought it. It had oil changes done regularly according to Carfax. It now only has 129,000 miles and the motor went out on it. We still owe approximately $16,000 on it and was told we need to pay for a new motor. We are at a loss of what to do. It’s hard enough paying $720 a month truck note. We can’t afford a new motor, not to mention the transmission was showing signs of slipping before the motor went out. So obviously if we were to get a new motor put in, we would probably have to turn around and pay for a new transmission. We have searched online and have seen reviews of people having the same issues we’re having. It’s the 2015 and 2016 series. My husband knows more of the mechanical issues than I do but I just happened up on this article and he’s not here to help me explain what actually caused the motor to go out. It has something to do with it changing from 6 cylinder to 8 cylinder. Supposedly to give it better gas mileage. At the moment we have stopped making payments for the truck and just waiting for them to repossess it. I credit is ruined. We are using an old Toyota 4-runner right now to get back and forth to work. We both work and have had hell trying to get us both to and from work. I have always been a Chevy girl but not anymore. What a disappointment. I’m hoping someone can help us. I think Chevy should have a recall and fix this mess.

    I own a 2015 Chevy Tahoe LTZ. Not only does my truck burns excessive oil, I replaced the transmission, the vacuum brake booster went out on me the same day I picked it up from getting the new transmission, causing me to crash. The new transmission jerks, stalls and shifts late. My truck has been at a Chevy dealer for almost a year because there is a problem with just about all of the recalls and special coverage issues that was issued for it. I also learned afterwards that there’s issues with the transmission and the vacuum brake booster has been repaired 4 years in a row (by the same Chevy dealer) meaning it goes bad every year. I now have issues with my motor, check engine light on. PLEASE HELP ME. General Motors does not give a care at all about these issues. I’m spending too much money on rental cars because I can’t afford to pay for all of the issues with my truck at once.

    I bought a silverado within a couple months my check engine came on and stability light, it started shifting weird and shaking I had to pull it in the garage and it’s been sitting here for months now making it hard to get to and from work which in return i have almost lost my job. I can’t afford to fix problems and continue finding more as I look.

    2015 Cadillac Escalade a lifter failed at 65,000 miles and different lifter failed at 78,000 miles, 104,000 & 107,000. Dealership reports the camshaft has been damaged and a new engine is needed. However, engines are on back order. I have been waiting for an engine for two months now and there is no timeframe of when an engine will be available. I owe $16,000 on the vehicle and the engine replacement is going to cost 11,000. GM has offered no help and resolving the issues. They called me weekly to let me know engine is on backorder.
