CBD oil, lotion, and edible next to pot leavesA recent California class action lawsuit filed against Koi CBD claims that the company misrepresented its products and sold illegal merchandise.

Lawsuit Claims CBD Edibles, Lotions, and Oil Mislabeled by Koi CBD

The lawsuit was filed by plaintiffs Calley Fausett and Leigh Good just days after Koi CBD was issued a warning by the U.S. Food and Drug Administration regarding the company’s marketing claims. According to Fausett and Good, they purchased CBD products from the company earlier this year due to these marketing claims. However, the plaintiffs claim that if they had been aware that these products were illegal, they would not have purchased them.

According to their lawsuit, Koi CBD illegally sold CBD edibles, lotion, oil, and gummies by marketing these products as drugs, supplements, and food products. Under the FDA’s regulations pertaining to drugs, supplements, and food, CBD may not be labeled as a dietary supplement or added to a food product. As Koi CBD’s products were labeled as supplements or foods, Calley and Leigh claim that the company’s products were illegally labeled.

In November 2019, the FDA sent Koi CBD a warning letter regarding product violations, including unapproved, misbranded, and adulterated products. The letter details false or unproven claims that are listed on Koi CBD’s website, including that CBD relieves pain and inflammation, fights breast cancer, lowers the risk of diabetes, and treats opioid addiction.

Fausett lives in Arizona, and claims that she purchased CBD oil from Koi CBD in June 2019. According to Fausett, she has purchased approximately $1,000 worth of CBD edibles and other products from Koi CBD over the past year. However, the plaintiff claims that she was unaware that these products were illegally marketed by the company, and that had she known, she would not have continued to purchase them.

Good lives in California, and claims that she purchased approximately $150 worth Koi CBD products. Good also claims that she was unaware that the products were illegally marketed and sold, and that she also would not have purchased them had she known.

According to their lawsuit, the claims made about Koi CBD’s products are false, fraudulent, deceptive, and misleading. Fausett and Good are seeking reimbursement and additional compensation for these claims. Their lawsuit covers a proposed class of other customers who also purchased products from Koi CBD.

After the 2018 Farm Bill legalized hemp and hemp-derived products, the CBD industry has rapidly exploded, and is expected to become a $16 billion industry by 2025. Due to CBD’s recent popularity, there is little regulation currently in place regarding these products. According to consumer reports and lawsuits, some CBD retailers may be taking advantage of this limited regulation in order to make false claims about CBD products in order to charge premium prices.
