Marijuana plant and stethoscopeCBD products are extremely popular in the United States, but the surge in the number of items sold has led to complaints from some consumers and even government involvement.

Recently, the FDA sent out letters to fifteen companies accused of illegally promoting CBD products in violation of the Federal Food, Drug, and Cosmetic Act.

In addition to naming specific violations by CBD companies of the Food, Drug, and Cosmetic Act, the agency raised their own concerns about some other risks associated with CBD products, Forbes reports. According to the current analysis of CBD items on the market, the FDA stated that they were unable to conclude that CBD is recognized as safe for use in animal or human food.

Currently, some have called the CBD landscape in the U.S. a “wild west” because of how quickly these products have become popular amidst a lack of clear regulations. The FDA stated that they are concerned that, due to the volume of products on the market, consumers might conclude that many of these have been tested or approved for use by the FDA — even though that is not the case.

Many concerns about the safety profile of CBD products and toxicity levels have popped up in news stories and recent investigations. Animal studies have reportedly shown that CBD can cause issues, including impairing sexual behavior, decreasing levels of testosterone, and impeding the function and development of sperm and the testes.

Products containing CBD oil come in many different forms available for sale today including teas, chocolate bars, oils, capsules, syrups, and creams.

As of right now, the only version of CBD on the market that has been reviewed by the FDA is a prescription version for people with seizures. Most products, however, have not undergone rigorous testing to determine the full risk and benefit profile.

Given the many formulations of CBD available from different companies, the side effects can vary. Some of the most commonly reported side effects with CBD products include reduced appetite, fatigue, drowsiness, and dry mouth.

CBD formulations can also cause interaction issues with other medicines, like blood thinners. Some consumers and regulators have voiced concerns about the variations in purity for CBD items for sale, too, including those in which higher levels of THC were identified in testing.

The true legal status of these different products is in flux even though it’s available in most U.S. states. Currently, the federal government views CBD in the same class as marijuana, which is illegal at the federal level. However, the government is not actively enforcing laws against CBD. People are able to access forms of CBD online without a medical license for cannabis.

Since the legality and regulation of CBD seem likely to change in the coming years, those sellers and buyers of CBD should make efforts to stay informed about updates in the industry. If additional reports of serious side effects are submitted to the government or covered in news stories, it’s very likely that some kind of regulation, especially over false advertising of CBD oil, will be enacted.
