Smartypants Multivitamins Overview:

  • Who: US consumers who purchased SmartyPants multivitamins.
  • Why: The manufacturer allegedly advertised SmartyPants multivitamins as “Complete” and “Essential” but failed to include important vitamins “that the body absolutely needs.”
  • Where: The nationwide class action lawsuit was filed in New York federal court Wednesday.

A pair of consumers says that SmartyPants multivitamins are falsely represented as “Complete” and containing “Essential” nutrition when they lack several vitamins deemed important by health authorities in a class action lawsuit lodged in New York federal court Wednesday.  

Lead plaintiffs, Bianna Foster and Jennifer Schultz, want to represent a nationwide Class of consumers who purchased various SmartyPants-branded products, along with several state subclasses. They accuse the manufacturer, SmartyPants, Inc, of “cheating” consumers by misrepresenting their products and charging a premium.  

SmartyPants Multivitamins Short Consumers on Essentials 

Foster and Schultz say they each purchased SmartyPants multivitamins based on the products’ labels stating they were “complete” and would provide “essential nutrition.” Despite these claims, SmartyPants multivitamins come up short when it comes to nutrition deemed essential by the US Food and Drug Administration (FDA), say the plaintiffs.  

“[T]hese purportedly ‘Complete’ and ‘Essential’ multivitamins fail to contain a number of essential nutrients, including vitamin K, riboflavin (vitamin B-2), and niacin (vitamin B-3),” states the SmartyPants multivitamins class action lawsuit. “So important are these vitamins that the[FDA] has identified them as among the ‘13 vitamins that the body absolutely needs.’” 

The plaintiffs accuse SmartyPants Inc of misrepresenting their products in order to charge unwitting consumers a hefty premium. They say the alleged false advertising constitutes negligent misrepresentation and breach of warranty, and also violates New York and California consumer protection laws.  

SmartyPants Multivitamins Sold Nationwide

Foster and Schultz want to represent a nationwide Class of consumers, along with New York and California subclasses, who purchased any of the following SmartyPants multivitamins: 

  • SmartyPants Kids Complete Multivitamin 
  • SmartyPants Kids Complete and Fiber Multivitamin 
  • SmartyPants Organics Vegetarian Kids Complete Multivitamin 
  • SmartyPants Organics Vegetarian Kids & Toddler Complete Multivitamin 
  • SmartyPants Teen Guy! Complete Multivitamin 
  • SmartyPants Men’s Complete Multivitamin 
  • SmartyPants Men’s MO Complete Multivitamin 
  • SmartyPants Masters Complete Multivitamin for Men 50+ 
  • SmartyPants Masters Complete Multivitamin for Women 50+ 
  • SmartyPants Adult Complete Multivitamin 
  • SmartyPants Adult Complete and Fiber Multivitamin 

They are seeking damages on behalf of Class Members, as well as a court order stopping the alleged false advertising of SmartyPants multivitamins.  

Consumers have been taking vitamin makers to court alleging their contents of their products are misrepresented. Bayer has been accused of misrepresenting popular Flintstone kids vitamins in a class action lawsuit. The makers of Rainbow Light prenatal vitamins paid $1.75 million to exit a class action lawsuit accusing the company of falsely representing the heavy metal content of certain products.

    I purchased many bottles of Smarty Pants believing they were as stated on the bottles. I have receipts with my purchases too.
