Supplement maker Best Nutritionals, LLC falsely advertises its line of supplements purporting to be made of “Pure Antarctic Krill,” claims a class action lawsuit filed in California federal court Tuesday.  

Lead plaintiffs, Luis Negrete, a California resident, and Side 2 Side, a New York resident, want to represent a nationwide Class of consumers who they say were entirely misled by Best Nutritionals when it comes to the content of its Krill-500, Krill-1000, and Krill 1250 supplements. They claim that independent lab testing of the products revealed that there is no krill in the supposed krill supplements.  

Both Negrete and Side 2 Side say that they purchased Best Nutritionals krill supplements based on labeling that said the product contained actual krill oil. They say they wanted supplements with kill oil because of its Omega-3 content, which has been linked to heart health benefits.  

Krill oil, made from “tiny, shrimp-like crustaceans that are found in abundance in the Antarctic Ocean,” are a rich source of Omega-3s. Similarly, fish oil contains Omega-3s, but krill oil is better, making it more expensive and desirable, according to the class action lawsuit.  

“Due to its relative scarcity, its unique properties and numerous health benefits, krill oil typically sells at premium over standard fish oil products making it an attractive commodity for unscrupulous suppliers to adulterate,” explain the plaintiffs who say that fish and soybean oils are often used as substitutes and a substance is added to make the caplets red so that they appear to contain real krill oil.  

Best Nutritionals took such a shortcut when it made its krill oil supplements. The plaintiffs say that lab testing of the company’s krill oil supplements “unequivocally” shows that the products do not contain authentic krill.  

Best Nutritionals krill supplements do not contain several substances that would indicate that real krill oil was used. Lab testing showed that the products are “clearly adulterated,” alleges the class action lawsuit.  

“This is a straight-forward case of adulteration, deception, and fraud,” states the lawsuit. “Defendant markets and sells a line of products which claim to be ‘Pure Antarctic Krill,’ the quality of which is further assured by the use of good manufacturing practices, and third-party testing.” 

Each of the plaintiffs say that they would not have purchased or paid as much for Best Nutritionals krill supplements had they known the truth. They want to represent consumers nationwide, along with New York and California subclasses, who they say were duped by the company’s false advertising.  

Negrete and Side 2 Side say that Best Nutritionals needs to pay Class Members damages and also stop the deceptive marketing of its krill oil products.

    We never truly know what actual ingredients are in a pill!!! We trust companies that produce what we consume for “better health”. To advertise a certain ingredient is in it and later find out that there is none, zilch nada is literally bold face lying to public. I have purchased and consumed many bottles believing I was getting krill. Add me to class action please.
