Polaris RZR defect class action lawsuit overview:
- Who: John H. Lindstrom filed a class action lawsuit against Polaris Inc.
- Why: Lindstrom claims Polaris manufactured and sold certain model year 2021-2024 RZR 200 vehicles containing a defect that renders them inoperable and that currently allegedly cannot be fixed.
- Where: The class action lawsuit was filed in Montana federal court.
Polaris manufactured and sold certain model year 2021-2024 RZR 200 vehicles, marketed for children, that are inoperable due to a defect that can cause them to lose steering-wheel control during operation, posing a crash hazard, a new class action lawsuit alleges.
Plaintiff John H. Lindstrom claims Polaris emailed him in September telling him to stop using the recalled RZR 200 vehicle, which he purchased for his grandchildren due to it being “specifically designed and marketed for use by children.”
Lindstrom argues he has been injured by the allegedly defective nature of the Polaris RZR 200 vehicles since his grandchildren are no longer able to use the vehicle and no fix is allegedly on the horizon.
“Employees at the dealership where he purchased the RZR 200 told him it may take six to twelve months for the fix to the problem with his vehicle,” the Polaris class action states.
Lindstrom wants to represent a nationwide and Montana class of consumers who purchased a Polaris RZR 200 vehicle that was subject to Polaris’ Safety Recall Z-23-06.
Polaris informs consumer there is no current fix for alleged RZR 200 defect, says class action
Lindstrom argues that, despite receiving an email notice from Polaris, he was unable to find the safety recall notice on the company’s customer recall site and that, after allegedly reaching out four times, he was told there was no fix.
“To date, there is still no fix to the problems with Lindstrom’s RZR and other similar RZRs,” the Polaris class action states.
Lindstrom claims Polaris is guilty of negligent misrepresentation, unjust enrichment, breach of contract, and breach of express warranty and of violating the Magnuson-Moss Warranty Act and the Montana Consumer Protection Act.
The plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual and statutory damages for himself and all class members.
Polaris has issued a number of different recalls in recent months, including over a pair of fuel leaks, an improperly welded seat belt bracket, dangerous handlebar hooks and a throttle and brake issue.

I bought a RZR 200 EFi for my grandchildren for Christmas 2022. They have only driven it a handful of times due to the stop order.
