A Pennsylvania resident is suing FanDuel over claims that its sports gambling apps are designed to be addictive and exploit users’ vulnerabilities.
Plaintiff Maurice Faulk’s civil lawsuit claims FanDuel’s gambling apps track user interactions to create hyper-personalized algorithms that bombard users with targeted notifications and advertisements at times when they are most susceptible, such as late at night or after a big loss.
Faulk argues FanDuel’s gambling apps offer promotions, such as deposit bonuses and “risk-free bets,” that mask losses and encourage users to place larger wagers while also using push notifications to direct users back to the app.
“FanDuel also offers casino gaming within [its] sports gambling apps, encouraging users to utilize the casino games as ‘instantaneous’ gambling through methods such as virtual slots,” the FanDuel lawsuit says.
He claims FanDuel is guilty of breach of warranty, negligent design, negligent failure to warn, negligence, intentional misrepresentation and unjust enrichment and violated the Pennsylvania Unfair Trade Practices and Consumer Protection Law.
FanDuel allegedly pushes users to gamble through ads, bonuses and notifications
Faulk claims FanDuel is aware of the addictive nature of its sports betting apps but continues to push users to gamble further through targeted advertising, personalized “bonus” incentives and “push” notifications.
He argues the platform puts users at risk through features like microbets on minor in-game events, push notifications, VIP loyalty programs, algorithm-driven ads and a lack of protective safety limits.
Faulk claims FanDuel knows how to curb compulsive gambling because its parent company already did so in the United Kingdom following a 2018 regulatory fine. The company was forced to adopt betting limits, age-based deposit caps and restrictions on VIP programs — measures Faulk argues could be applied in the United States to reduce harm.
The plaintiff alleges FanDuel’s gambling apps have caused him to suffer from gambling addiction, financial strain and mental health issues, such as depression and anxiety.
He demands a jury trial and requests declaratory and injunctive relief and an award of compensatory and punitive damages.
In 2025, a class action lawsuit filed against gambling company DraftKings was dismissed after a Pennsylvania judge ruled that state law does not impose a legal “duty of care” on sportsbooks to monitor customers’ gambling habits or protect them from developing gambling addictions.
