DentaQuest class action lawsuit overview:

  • Who: Plaintiff Amanda Whitlow filed a class action lawsuit against DentaQuest Group Inc. and DentaQuest LLC.
  • Why: Whitlow claims DentaQuest failed to properly safeguard the personally identifiable information of 15 million patients during a recent data breach.

A new class action lawsuit alleges DentaQuest is liable in a recent data breach that exposed the personally identifiable information of 15 million patients.

Plaintiff Amanda Whitlow claims DentaQuest failed to comply with regulatory, legal, ethical and industry standards for cybersecurity and confidentiality of patient records.

As a result, Whitlow argues that unauthorized third parties were able to access and steal patients’ private information, including names, dates of birth, Social Security numbers, health insurance policy numbers, Medicaid/Medicare numbers and dental or vision health information, such as provider names, diagnoses, treatments and billing information.

“[DentaQuest] failed to comply with regulatory, legal, ethical and industry standards for cybersecurity and confidentiality of patient records, failed to take reasonable security measures, such as training employees to identify phishing emails, employing biometric or multi-factor authentication requirements for authorized users, and monitoring for unusual activity,” the DentaQuest class action lawsuit says.

Class action claims DentaQuest delayed notifying patients about data breach

Whitlow claims DentaQuest discovered unauthorized activity on its computer network on May 20 but did not notify patients until August, giving cybercriminals a head start to commit identity fraud and theft and wreak havoc on patients’ personal finances, identities and accounts.

“As a direct result of the DentaQuest data breach, [the] plaintiff and class members have suffered numerous concrete injuries and will suffer additional injuries into the future,” the DentaQuest class action lawsuit says.

Whitlow alleges DentaQuest is guilty of negligence, breach of implied contract, breach of fiduciary duty, unjust enrichment and violation of the Illinois Personal Information Protection Act.

She demands a jury trial and requests injunctive and declaratory relief, monetary damages and all other relief as authorized in equity or by law.

In a Massachusetts class action lawsuit filed against DentaQuest on June 4, the plaintiff alleges DentaQuest delayed notifying victims even after the ShinyHunters hacker group claimed responsibility for the cyberattack.
