Trump Twitter Class Action Lawsuit Overview: 

  • Who: Donald Trump has asked a federal judge not to dismiss a class action lawsuit the former president filed against Twitter.
  • Why: Trump claims Twitter violated his free speech when it banned him from its social media platform.
  • Where: The class action lawsuit was filed in California federal court.

Donald Trump has asked a California federal judge to keep a class action lawsuit alive that the former president filed against Twitter after it banned him from its platform.

Trump claims the ban violates his protected free speech and came only after the social media company was coerced by the federal government. 

Twitter is attempting to get the class action lawsuit dismissed, arguing it was within its First Amendment rights to decide for itself what it wanted to have put out on its platform, Law360 reports.

Trump, however, claims Twitter only banned him after it was pressured by Democratic lawmakers and that the social media company weaponized protections given to it by Section 230 of the Communications Decency Act in doing so. 

Trump is seeking to get an order declaring that Section 230 is “unconstitutional” and enables companies such as Twitter from being able to stifle the public postings of him and his supporters.

Trump Calls Removal ‘Partisan Censorship,” Violation Of U.S. Constitution

Twitter, Trump claims, became a government actor after it decided to remove him from the platform, which he calls “partisan censorship” and a violation of the U.S. Constitution. 

Further, being banned from the platform resulted in “the prior restraint of millions of Americans’ freedom to participate in the public discourse,” Trump says. 

Trump has also filed complaints against YouTube and Facebook after he was removed from their platforms following the Jan. 6, 2021, insurrection in the U.S. Capitol, Law360 reports.

A separate class action lawsuit accusingTwitter, Google and other tech companies of allowing “fake news media” outlets to dominate search results was dismissed in 2019. 

Prior to his presidency, a class action lawsuit was filed against Trump by real estate students of Trump University who claimed the school was falsely promoted as an accredited institution

    Yes, Twitter violated his right to free speech, as it seemed the Democrats did influence Twitters decision on it. How can one entity like Twitter what they base their site on is free speech by it’s users, all of sudden decide to ban one person’s views. Especially when that person is The President of The United States, no matter if they’re in agreement with his views or not. I feel Twitter should shut down for what I call an act of Treason against my President. He was and always will be.

    They are private companies and say false claims and doing treasonous actions against the country he should be jailed

    Maybe you should add a of America. When they silenced my president they violated my constitutional rights by blocking free speech. This is a disgrace and Twitter should pay every American for violation of our rights and be banned from doing any kind of business in America.

    Of course his voice was silenced. Yes, his rights were violated. He’s not alone either. Agree or disagree with the views people have, but to silence anyone is a violation of their right to free speech & everyone should defend their right to say whatever they want to say, while you still can.
